Previous issue date: 2001 / The changes that have occurred in the Brazilian work market, mainly due to the opening of the economy in the 90th decade, have caused, as a consequence, the unemployment in the formal sector, with the reduction of posts of work in the industry and the precarization of the laborwork. In order to face these questions, it¿s necessary an analysis of the alternative measures, among them, the creation of the cooperative societies, which have increased about 90,8% in the last years. The purpose of this study is to identify and to analyze the functions of the work cooperatives, just in face of the changes of the Brazilian society. The analysis was directed towards a group of eight work cooperatives that work in lots of areas of professionals in the Municipality of Rio de Janeiro. The study reveals the existence of false work cooperatives, whose sole purpose is to intermediate the handiwork with the intention of benefiting enterprises that intend to decrease their own costs of production, just contributing for the precarization of the relations of work. The structure of the Judicial Power offers solutions that protect the workers who are exploited through fraudulent actions, by the false cooperatives, handiworkers. It can be noticed that this structure is enough to answer the challenges presented. It means that it is too bad to apprehend the revival of the work cooperativism and that it must be combated. Of course, it is maniqueist conception that distorts reality and disdains positive aspects of cooperative system. The results of the search have permitted to point out the main characteristics of the work cooperatives analyzed, the profile of the cooperative workers, and also the main obstacles to the development of the cooperative system in Brazil today . A long the analysis of tributary and labor questions and about the participation of the cooperative workers in the management of the cooperative - the most questionable points - it could be observed the development of real cooperative practices, trying to establish the differences between these and the fraudulent ones, also studied in this work. This study represents a contribution to all those who intend to study new relations of work in a critical away and from experiences in development. / As mudanças ocorridas no mercado de trabalho brasileiro em decorrência, principalmente, da abertura da economia na década de 90, trouxeram como conseqüência uma diminuição de empregos no setor formal, com redução de postos de trabalho na indústria e a precarização do mercado de trabalho. Para o enfrentamento destas questões, torna-se necessária a análise de medidas alternativas, entre elas as cooperativas de trabalho, cujo crescimento nos últimos anos foi da ordem de 90,8%. O presente trabalho tem por objetivo identificar e analisar o papel das cooperativas de trabalho face às transformações da sociedade brasileira. A análise voltou-se para um grupo de oito cooperativas de trabalho que atuam em diversas áreas profissionais no Município do Rio de Janeiro. O estudo mostrou a existência de 'falsas cooperativas' cujo único objetivo é intermediar mão-de-obra com o intuito de beneficiar empresas que visam a reduzir seus custos de produção, contribuindo para a precarização das relações de trabalho. A estrutura do Poder Judiciário oferece soluções para amparar o trabalhador explorado por práticas fraudulentas de aproveitamento da mão-de-obra cooperativada. Chama a atenção, porém, para o fato de que considerar que essa estrutura seja suficiente para responder aos desafios colocados, significa reconhecer o ressurgimento do cooperativismo de trabalho como um mal a ser combatido. Trata-se de uma concepção maniqueísta, que distorce a realidade e despreza os aspectos positivos do cooperativismo. Os resultados da pesquisa realizada permitiram assinalar as principais características das cooperativas de trabalho estudadas, o perfil dos cooperados, bem como os principais obstáculos ao desenvolvimento do cooperativismo de trabalho, hoje, no Brasil. Na análise de questões tributárias, trabalhistas, de participação do cooperado na gestão da cooperativa - principais dificuldades detectadas - evidenciou-se o desenvolvimento de práticas cooperativistas autênticas, procurando-se estabelecer a diferença entre estas e outras práticas fraudulentas, analisadas durante a pesquisa. Representa, pois, o presente estudo uma contribuição a todos aqueles que se dispõem a estudar novas relações de trabalho, de uma forma crítica e a partir de experiências em desenvolvimento.
