En el presente artículo, se cuestiona la exclusión de las mujeres trans como
sujetos pasivos del delito de feminicidio en el Acuerdo Plenario N°001-2016/CJ-
116. A fin de promover su inclusión, se propone consider al término mujer como
elemento normativo del tipo, lo que implica adoptar un concepto amplio de mujer.
Este deberá tomar en cuenta la dimensión dinámica del derecho a la identiad y
la identidad de género. Lo anterior de conformidad con lo dispuesto por el
Tribunal Constitucional y la Corte Interamericana de Derechos Humanos, y en la
misma línea de lo resuelto por los tribunales de Colombia y Argentina. Asimismo,
el artículo resalta que una interpretación como la propuesta no es completamente
contraria a la línea jurisprudencial de la Corte Suprema. / In this article, the exclusion of trans women as passive subjects of the crime of
femicide in the Plenary Agreement Nº 001-2016 / CJ-116 is questioned. In order
to promote their inclusion, it is proposed to consider the term woman as a
normative element of the criminal offense, which implies adopting a broad
concept of woman. This should take into account the dynamic dimension of the
right to identity and gender identity. The foregoing in accordance with the
provisions of the Constitutional Court and the Inter-American Court of Human
Rights, and in the same line as that resolved by the courts of Colombia and
Argentina. Likewise, the article highlights that an interpretation such as the
proposed one is not completely contrary to the jurisprudential line of the Supreme
Court.
