Previous issue date: 2013-08-23 / The conception of Legal Aid Organizations LAO as seeing in Brazil is an up-to-date and
emancipatory legal movement, that puts itself at service of the struggle of the oppressed classes for a dignified life, understanding the Law as an instrument of social transformation and human emancipation. It is a practice that develops in the academic scenario, through extension projects and, in society, through legal advice to popular movements, trade unions and non-governmental organizations, always linked to the issue of human rights. It is important to clarify that this is not a theory or a school, but a movement that, a few years ago, has been consolidated as an alternative to traditional legal practice. Setting itself also as a field of discussions, debates, reflections and practices on Law, Critical Legal Studies, Human Rights, Society, Politics, Social Movements. In this context, the objective of this thesis is show the emancipatory power of LAO, from conception of Law as a instrument counterhegemonic in the service of the popular sectors of society. LAO, in turn, when developing judicial and extrajudicial actions to reverse social inequality and give visibility to the subject historically oppressed plays an emancipating role. Thereby, this thesis has been elaborated,
analyzing, initially, the historical context in which Law has developed, from Modernity to Post-Modernity, noting that the current Post-positivist and New Constitutionalist moment favors the expansion of Legal Aid Organizations . Then, we deep the theoretical frameworks of LAO, basing it on a critical emancipatory legal thinking comprising mainly the Participatory Community Legal Pluralism proposed by Antonio Carlos Wolkmer and
theoretical formulations from Boaventura de Sousa Santos in The Epistemologies of the
South, Sociology of Absences and Emergence and the Translation Work. After the
development of the theoretical basis of LAO, we detail the elements that constitute it. Thus, we present the historical context in which it developed, its typologies, the subjects involved in this movement, outline their characteristics and identify their assumptions and goals. Finally, we evaluate from a field research, the cearense experience in Legal Aid Organizations and the movements assisted by them, seeking to confirm hypothesis of our work which is the emancipatory potential of LAO and of Law.

serviço da luta das classes oprimidas por uma vida digna, compreendendo o Direito como um instrumento de transformação social e emancipação humana. Trata-se de uma práxis que se desenvolve no âmbito acadêmico, por intermédio de projetos de extensão universitária e, na sociedade, por meio da assessoria jurídica a movimentos populares, sindicatos ou
organizações não governamentais, sempre ligada à temática dos direitos humanos. É
importante esclarecer que não se trata de uma teoria ou uma escola, mas de um movimento
que, há poucos anos, vem-se consolidando como uma alternativa à prática jurídica tradicional. Constituindo-se, também, como um campo de discussões, debates, reflexões e práticas sobre Direito, Crítica Jurídica, Direitos Humanos, Sociedade, Política, Movimentos Sociais. Nesse contexto, o objetivo desta tese é mostrar o poder emancipatório da AJP, a partir da concepção do Direito como um instrumento contra-hegemônico a serviço dos setores populares. A AJP, ao desenvolver ações judiciais e extrajudiciais para reverter a desigualdade social e dar visibilidade aos sujeitos historicamente oprimidos cumpre um papel emancipador. Desse modo, a presente tese foi elaborada, analisando, inicialmente, o contexto histórico em que se desenvolveu o Direito, da Modernidade à Pós-Modernidade, ressaltando que o atual momento
Pós-positivista e Neoconstitucional favorece a expansão da assessoria jurídica popular. Em seguida, aprofundamos os referenciais teóricos da AJP, fundamentando-a em um pensamento jurídico crítico emancipatório que compreende, principalmente, o Pluralismo Jurídico Comunitário Participativo proposto por Antonio Carlos Wolkmer e as formulações de Boaventura de Sousa Santos sobre Epistemologias do Sul, Sociologia das Ausências e das Emergências e o Trabalho de Tradução. Após a elaboração das bases teóricas da AJP,
passamos a detalhar os elementos que a constituem. Assim, apresentamos o histórico em que ela se desenvolveu, as suas tipologias, os sujeitos envolvidos nesse movimento, delineamos suas características e identificamos seus pressupostos e objetivos. Por fim, analisamos, a partir de uma pesquisa de campo, as experiências cearenses em assessoria jurídica popular e os movimentos por elas assessorados, buscando confirmar a hipótese de nosso trabalho, qual seja, o potencial emancipatório da AJP e do Direito.
