Previous issue date: 2012-06-05 / Recognizing the need to preserve a national ethnic minority, the Constitution, inspired by the
pluralistic values of the Constitutional Law State, stipulated a series of rights and guarantees
for the conservation of indigenous cultural singularity, disciplining in article 231 the Indians
right to maintain their social organization, customs, languages, beliefs and traditions, as well
as safeguarding the rights to the lands they traditionally occupy, and the exclusive use of the
wealth existing in them, premise of ensuring their physical and cultural continuity, breaking
decisively with the paradigm the assimilation of the Indian national civilization. However,
despite the Indian policy of ethnic and cultural preservation, the Constitution allowed the
exploitation of minerals in aboriginal territory, incorporated herein hydrocarbons, provided
they meet certain predetermined requirements, leaving it to the legislature the discipline of
ordinary matter. However, this law has not yet been published, with some projects in the
National Congress, leaving thus precluding the indigenous subsurface oil exploration until the
enactment of enabling legislation. Meanwhile, this paper carries out an integrated analysis of
the constitutional protection of ethnic and cultural uniqueness of indigenous peoples,
Convention N? 169 of the International Labour Organization and the bill presented by Deputy
Eduardo Valverde, in an attempt to consolidate sustainable development practices in the
sector, through developing a system of social and environmental responsible oil exploration,
aligning with national energy needs to maintain a balanced environment and preservation of
socio-cultural organization of a minority so weakened and beaten over five centuries of
domination / Reconhecendo a necessidade de preservar uma minoria ?tnica nacional, a Constitui??o
Federal, inspirada nos valores pluralistas do Estado Constitucional de Direito, estipulou uma
s?rie de direitos e garantias em prol da conserva??o da singularidade cultural ind?gena,
perfilhando em seu artigo 231 o direito dos ?ndios em manter sua organiza??o social, seus
costumes, l?nguas, cren?as e tradi??es, al?m de resguardar os direitos origin?rios sobre as
terras que tradicionalmente ocupam e o usufruto exclusivo das riquezas nelas existentes,
premissa inafast?vel da garantia de sua continuidade f?sica e cultural, rompendo
definitivamente com o paradigma da assimila??o do ?ndio ? civiliza??o nacional. Entretanto,
apesar da pol?tica indigenista de preserva??o ?tnica e cultural, a pr?pria Constitui??o
possibilitou a explora??o de min?rios em territ?rio abor?gene, aqui inclu?do os
hidrocarbonetos, desde que observadas algumas exig?ncias preestabelecidas, ficando a cargo
do legislador ordin?rio a disciplina da mat?ria. No entanto, esta lei ainda n?o foi editada,
existindo alguns projetos em tramita??o no Congresso Nacional, restando, por conseguinte,
inviabilizada a explora??o petrol?fera em subsolo ind?gena at? a promulga??o da legisla??o
competente. Neste ?nterim, o presente trabalho realiza uma an?lise integrada entre as
disposi??es constitucionais de tutela ? singularidade ?tnica e cultural ind?gena, a Conven??o
n? 169 da Organiza??o Internacional do Trabalho (OIT) e o projeto de lei apresentado pelo
Deputado Eduardo Valverde, na tentativa de consolidar o desenvolvimento sustent?vel nas
pr?ticas do setor, atrav?s da estrutura??o de um regime socioambiental respons?vel de
explora??o petrol?fera, compatibilizando a necessidade energ?tica nacional com a manuten??o
do meio ambiente equilibrado e preserva??o da organiza??o sociocultural de uma minoria t?o
fragilizada e agredida ao longo de cinco s?culos de domina??o
