Previous issue date: 2014-04-30 / This work addresses the practice of listening to children and adolescents in legal processes and nurture responsibility (ward) in Venezuela. Regarding rights and participation as one of the mainstays of children recognition as people of rights, it is important to understand the way children are heard and their words considered in judicial sentences. This work uses qualitative methodologies and, besides an analysis of legal sentences, employs technics like the spaces observation and semi-structured interviews to protection judges and officials of the multidisciplinary apparatus of the Protection Circuit of Children and Adolescents in the Caracas s Metropolitan Area. The analysis is based on the anthropologic bibliography about the creation of new subjects of rights, childhood production and the children and childhood State management ways. This investigation seeks to contrast LOPNNA s (Law for protection of children and adolescents) principles, legal dispositions and procedures with the practices of actors forming the judicial custody process: judges and multidisciplinary apparatus, children and families in an attempt to achieve the ideal of letting children have a voice. / O trabalho aborda a pr?tica de escuta de crian?as e adolescentes em processos judiciais de cust?dia e responsabilidade de cria??o (guarda) na Venezuela. Considerando o direito a participa??o como um dos pilares do reconhecimento das crian?as como sujeitos de direitos, interesso-me por entender o modo como as crian?as s?o escutadas e suas falas consideradas nas senten?as judiciais. O trabalho faz uso de metodologias qualitativas e teve por t?cnicas, al?m da an?lise de senten?as, a observa??o dos espa?os e entrevistas semiestruturadas realizadas com ju?zes de prote??o e funcion?rios da equipe multidisciplinar do Circuito de Prote??o de Crian?as e Adolescentes da Zona Metropolitana de Caracas. Para a an?lise utilizo a bibliografia antropol?gica sobre constru??o de novos sujeitos de direitos, produ??o de inf?ncia e formas de gest?o da inf?ncia e da crian?a pelo Estado. Procuro contrastar os princ?pios, disposi??es legais e os procedimentos da Lei Org?nica para a Prote??o de Meninos, Meninas e Adolescentes com as pr?ticas dos agentes que formam parte do processo judicial de cust?dia: ju?zes e equipes multidisciplinares, crian?as e fam?lias na tentativa de realizar o ideal de dar voz ?s crian?as.
