Previous issue date: 2017-02-10 / Fundo Mackenzie de Pesquisa / Universidade Presbiteriana Mackenzie / This essay aims to answer the following questions: what are and how were human rights born? In order to answer these questions, we will first investigate how was born the concept of what is understood by human rights today. Next, we will research the history of the recent traditions of the rights, the Droit de l'homme et du citoyen and the rights of man, comparing them with the current human rights, to do so, we will use as a theoretical reference the Samuel Moyn’s work, an author who is a milestone in the historiography of human rights. In doing so, it will be seen that they are not the logical sequence of these ancient traditions of rights. With this, one can see that the history of human rights is not a linear history, much less a historical "trend". In the second part of the essay, after presenting a definition of human rights, we will address the efficacy of these rights. And we will take as theoretical reference Beth Simmons’s and Richard Posner’s works. These authors were chosen because Simmons represents the first great work with great investments of human and financial capital on the subject, and Posner's is the most recent work on the subject with the same qualities. In one way or another, both conclude their work by recognizing that human rights treaties did little or nothing to contribute to the development of people's well-being Finally, we will carry out an analysis of rights in capitalism, and then understand more deeply why human rights have today the "form" that they have. In doing so, it will be seen that human rights are a form of mercantile exchange relations at the international level. / O presente trabalho visa responder às seguintes perguntas: o que são e como nasceram os direitos humanos? Para que se possa responder essas perguntas, primeiramente, investigaremos como nasce o conceito fundamental do que se entende por eles na atualidade. Em seguida, deve-se pesquisar a história das recentes tradições dos direitos, os Droit de l'homme et du citoyen e os rights of man, comparando-as com os atuais direitos humanos, para tanto, utilizaremos como referencial teórico os trabalhos de Samuel Moyn, autor que representa um marco na historiografia dos direitos humanos. Ao fazê-lo, constatar-se-á que eles não são a sequência lógica dessas antigas tradições de direitos, mas um instrumento político e econômico com contornos específicos da era do neoliberalismo. Com isso, pode-se perceber que a história dos direitos humanos não é uma história linear, muito menos uma “tendência” histórica. Na segunda parte do trabalho, após apresentar uma definição de direitos humanos, trataremos da eficácia desses direitos, sendo que, tomaremos como referencial teórico os trabalhos de Beth Simmons e Richard Posner. Tais trabalhos foram escolhidos, pois o de Simmons representa o primeiro grande trabalho com grandes investimentos de capital humano e financeiro a respeito do tema, já o de Posner se trata do mais recente trabalho de vulto sobre o tema, com as mesmas qualidades. De uma forma ou de outra, ambos concluem seus trabalhos reconhecendo que os tratados de direitos humanos em nada ou muito pouco contribuíram para o desenvolvimento do bem-estar das pessoas. Por fim, realizaremos uma análise dos direitos no capitalismo, para, em seguida, entender mais a fundo por que os direitos humanos têm hoje a “forma” que têm e quais são as implicações dessa forma. Ao se fazer isso, constatar-se-á que os direitos humanos são uma forma das relações de troca mercantil em nível internacional, isto é, das relações sociais por intermédio das quais se busca a submissão mundial aos interesses do capital.
