Previous issue date: 2008-05 / Esta dissertação objetiva proceder a uma reconstrução dos debates sobre organização sindical na Assembléia Nacional Constituinte de 1987/1988, tendo por linha de investigação a problemática da unicidade sindical. O pressuposto da pesquisa é o de que a reconstrução proposta pode fornecer novas perspectivas para discussões presentes acerca do tema. O paternalismo dos sindicalistas que participaram dos debates para a elaboração da Constituição e dos próprios constituintes conduziu à manutenção da regra do sindicato único por categoria, em nítido contraste com a garantia, no mesmo texto constitucional, da liberdade e da autonomia sindicais. Aqueles atores se depararam com o dilema entre romper ou manter os principais elementos da estrutura sindical construída na década de 1930 e mantida praticamente intocada até o final da ditadura militar. Concepções que recorriam à "hipossuficiência" dos trabalhadores e à necessidade de sua proteção em face dos riscos que poderiam conduzir a uma fragmentação do movimento sindical reduziram a discussão na Constituinte à simples escolha entre unicidade e pluralidade. Construções causais vazias de conteúdo ocultavam, porém, um paternalismo próprio da crise do Estado de Bem-Estar Social e que ensejava a limitação da autonomia dos cidadãos. Os debates constituintes acabaram desconectados da importância da garantia de uma liberdade sindical efetiva como dimensão da capacidade de autodeterminação de trabalhadores e empregadores. A competência decisória desses últimos era negada diante da determinação constitucional da sua forma de organização coletiva. Trabalhadores e empregadores eram conseqüentemente privados de um contexto sindical verdadeiramente democrático. O presente trabalho tenta mostrar que a discussão sobre a unicidade diz respeito, de um lado, ao exercício da liberdade sindical e, de outro, ao reconhecimento da capacidade de trabalhadores e empregadores de decidir sobre seus próprios destinos, enquanto titulares do direito de autodeterminação individual. As conclusões da pesquisa indicam também que a manutenção da unicidade está relacionada ao momento de transição em direção a um Estado Democrático de Direito. A Constituição de 1988 é ela própria um reflexo do processo de construção sempre incompleto e aberto da identidade constitucional, processo esse que, por sua vez, não está imune a avanços e retrocessos. _______________________________________________________________________________ ABSTRACT / This thesis tries to make a reconstruction of the debates about union organization in the National Constituent Assembly of 1987/1988. The line of the investigation is the problematic question of the legal imposition of only one union to represent a certain professional or economic category in a determinate territorial area. The research assumes that this reconstruction may offer a different view for nowadays questions concerning union organization. The paternalistic perspective of the trade union leaders who participated of the making of the Constitution and of the constituents themselves lead to the maintenance of that legal imposition, in an evident contrast to the guarantee of union’s freedom and autonomy in the same constitutional text. Those actors faced the dilemma between the rupture or the preservation of the principle elements of the union’s structure built in the thirties and preserved almost unchanged until the end of the military dictatorship. Conceptions that resort to a claim of workers incapacity and a necessity of their protection from the risks that could lead to the fragmentation of the labour movement reduced the constituent debate to the simply choice between the rule of only one union or plurality. Empty causal constructions occulted, however, a paternalism typical of the Welfare State’s crisis and that implied a restriction of citizens autonomy. The constituent debates were disconnected from the importance of guaranteeing a effective union’s freedom as a dimension of the self-determination capacity of workers and employers. Their decision competence was rejected due to the constitutional determination of their form of collective organization. Workers and employers were deprived of a truly democratic context in what concerns union organization. This thesis tries to show that the discussion about the legal imposition of only one union concerns, from one hand, the exercise of union’s freedom, and, from the other, the recognition of workers and employers capacity of deciding their own destinies, as owners of the right of individual self-determination. The conclusions of the research also indicate that the maintenance of the imposition of only one union is related to the transition’s moment toward a Democratic Rule of Law. The 1988’s Constitution is itself a reflex of the ever opened and incomplete building process of the constitutional identity. This process, by its turn, is not immune to advances and regressions.
