Trata-se de relatório conclusivo vinculado à linha de pesquisa Instrumentos de
Acesso à Justiça e Tutela de Direitos, subárea de concentração Direitos Humanos e
Educação, do Programa de Pós-Graduação Stricto Sensu Mestrado Profissional e
Interdisciplinar em Prestação Jurisdicional e Direitos Humanos, da Universidade
Federal do Tocantins, em parceria com a Escola Superior da Magistratura
Tocantinense, dedicado à construção de diagnóstico sobre o processo de ensinoaprendizagem
em Direitos Humanos nos cursos de Direito do Estado do Tocantins.
Conhecer a realidade regional de como se dá, na formação jurídica, o ensino e a
aprendizagem dos Direitos Humanos decorreu da necessidade do Núcleo de
Estudos e Pesquisas Empíricas no Direito e na Educação (UFT/ESMAT) de dados
confiáveis que possibilitassem o desenvolvimento de ações de intervenção na área.
A pesquisa seguiu a atual corrente de expansão da pesquisa empírica em Direito e
adotou abordagens multimetodológicas. Os dados foram obtidos por meio de
pesquisa exploratória, análise de conteúdo da totalidade dos projetos políticos
pedagógicos dos cursos e aplicação de questionários aos alunos, professores e
coordenadores de curso. Os processos da análise e interpretação dos dados foram
embasados por pesquisa de referenciais teóricos da literatura da área, bem como as
orientações legislativas aplicáveis. Para ser possível afirmar se os cursos de Direito
do Tocantins atendiam às exigências de tratamento da temática e como o faziam,
foram definidos três indicadores, tendo como base as exigências legais do Plano
Nacional de Educação em Direitos Humanos e a Resolução CNE Nº 01/2012, sendo
estes: as formas inter e transdisciplinar; a forma disciplinar; e os projetos de
pesquisa e extensão. Assim, foi possível mapear nos projetos políticos pedagógicos
como os cursos tratavam a temática por meio da realização de análise de conteúdo
(Bardin). Com as respostas dos sujeitos, estabeleceu-se uma triangulação que
possibilitou a caracterização do processo de ensino-aprendizagem. Além da
construção do diagnóstico, a pesquisa forneceu a caracterização social dos cursos,
instituições e comunidade acadêmica dos cursos de Direito do Estado, bem como
possibilitou a construção de um checklist propositivo que sugere mecanismos de
aperfeiçoamento da prática educativa voltada aos Direitos Humanos, tendo em vista
a necessidade de promover a plena inserção desta temática na educação jurídica,
possibilitando uma formação profissional e cidadã voltada à preservação e à defesa
dos direitos humanos. / This is conclusive report entailed to the approach research Instruments line to the
Rights Justice and Guardianship, sub area of Human Right concentration and
Education, of the Postgraduation Program Stricto Sensu Masters Professional and
interdisciplinary in Adjudication and Human Rights, of Tocantins' Federal University,
in partnership with superior school of the Judicature Tocantinense and dedicated to
the diagnosis construction on the teaching-learning process in Human Rights, in the
Right courses of Estado do Tocantins. Know the regional reality of as if gives, in the
juridical formation, the teaching and the learning of the Human Rights resulted of the
need to Studies Nucleus and Empiric Researches in the Right and in the Education,
for reliable data that enabled the intervention actions development in the area. The
research followed the expansion current chain of the empiric research in Right and
adopted approaches multi-methodologies. The data were obtained through
exploratory research, totality courses and application political-pedagogical projects
content analysis of questionnaires to the students, courses professors and
coordinators. The data analysis and interpretation processes were based by
references research theoretical of the literature of the area, as well as the applicable
legislative orientations. To be possible to affirm if the Right courses of Tocantins
attended the treatment exigencies of the thematic and as they did it, they were
defined three indicators, to characterize this assistance having as base the Education
National Plan legal exigencies in Human Rights and the Resolution CNE Nº 01/2012,
being these: The forms interdisciplinary and transdisciplinary; The discipline form;
And the research and extension projects. This way, it was possible charty in the
pedagogical political projects as the courses treated to the thematic, through the
content analysis accomplishment (Bardin), and with the subjects answers it
established a triangulation, that enabled the teaching process characterizationlearning.
Besides the diagnosis construction, the research supplied the social
characterization of the courses, right courses Institutions and academic community of
the Estado, as well as it enabled the construction of a checklist propositional that
suggests improvement mechanisms of the geared educational practice to the Human
Rights having in mind the need to promote the full insert of this thematic inside the
juridical education, enabling a professional formation and geared citizen to the
preservation and defense of the human rights.
