Previous issue date: 2013-08-26 / The conceptions on the dignity of the person human being, on basic the human and right
rights, reveal the duty of protection of the State in relation to the crime victims and abuse of power, having the Organization of the Nations Units - UN acclaimed in 1985 its rights minimums through the Declaration of basic principles of justice for victims of crime and abuse of power. By means of the qualitative research inquiry under the approach of the crime victim and abuse of the power was carried through. The historical retrospect revealed moments and gradations differentiated on the participation of the victim in the resolution of the criminal conflict, being, currently, identified the phase of its revaluation. In this direction, the strategies contained in the Brazilian procedural legislation after the Federal Constitution of 1988 reveals the absorption of humanitarian principles in relation to the crime victim, as well as the existence of procedural mechanisms that had extended the possibility of bigger protection for the same one, even so for the victims of abuse of authority still are necessary to
surpass the deficit of existing protection. In relation to its access to Justice, the Public Defender's Office withholds attribution to give legal and judiciary assistance to the crime victim; to search its protection next to the State, as well as promoting its rights basic.

fundamentais, revelam o dever de proteção do Estado em relação às vítimas de criminalidade e abuso de poder, havendo a Organização das Nações Unidades ONU aclamado, em 1985, seus mínimos direitos através da Declaração de princípios básicos de justiça para vítimas de crime e abuso de poder. Por meio da pesquisa qualitativa foi realizada investigação sob o enfoque da vítima de criminalidade e abuso do poder. A retrospectiva histórica revelou momentos e gradações diferenciadas sobre a participação da vítima na resolução do conflito criminal, sendo, atualmente, identificada a fase de sua revalorização. Neste sentido, as estratégias contidas na legislação processual brasileira após a Constituição Federal de 1988 revelam a absorção de princípios humanitários em relação à vítima de criminalidade, assim como a existência de mecanismos processuais que ampliaram a possibilidade de maior proteção para esta, embora para as vítimas de abuso de autoridade ainda seja necessário superar o déficit de proteção existente. Em relação ao seu acesso à Justiça, a Defensoria Pública detém atribuição de prestar assistência jurídica e judiciária à vítima de criminalidade; de buscar sua proteção junto ao Estado, assim como de promover seus direitos fundamentais.
