El presente trabajo académico recoge normativa actual que está siendo aplicable a nivel
registral con respecto a los pactos de reserva de aires y la independización de aires sobre
aires, teniendo en cuenta que aires y azoteas son conceptos jurídicos equiparables. A partir
de dichas fuentes, lo que se busca es plantear una distinción entre ambos conceptos y observar
cómo es que en doctrina extranjera no se emplea los términos aires o azotea, sino surge la
idea del derecho a vuelo, aspecto que intentaremos proponer como futuro cambio normativo
en el Perú. Por otro lado, se analizará y cuestionará los precedentes de observancia obligatoria
que dieron origen a los respectivos acuerdo plenarios que serán mencionados más adelante,
debido a que no cumple con un correcto análisis crítico de las instituciones e inclusive, crean
nuevos problemas jurídicos al registro y confusión a los usuarios. / This academic work includes current regulations that are applicable at the Superintendency
of Public Registries (SUNARP) according to air reserve agreements and the independence
of airs on airs, taking into account that airs and roofs are comparable legal concepts. From
these sources, what is sought is to raise a distinction between both concepts and observe how
it is that in foreign doctrine the terms air or roof is not used, but the idea of the right to flight
arises, an aspect that we will try to propose as a future change normative in Peru. On the
other hand, the precedents of mandatory observance will be analyzed and questioned,
because it does not comply with an adequate critical analysis of the institutions and even
creates new legal problems for registration and confusion for users.
