El presente trabajo examinará la identificación y el abordaje brindado por la Policía
Nacional del Perú, el Ministerio Público y el Poder Judicial respecto al control económico
en las relaciones de pareja como forma de violencia contra las mujeres basada en
género, en la atención de denuncias judicializadas por violencia física y psicológica en
la ciudad de Arequipa, en el marco de la Ley N° 30364, Ley para prevenir, sancionar y
erradicar la violencia contra las mujeres y los integrantes del grupo familiar y a la luz del
derecho de acceso a la justicia.
A partir de la teoría de la rueda del poder y control de E. Pence y M. Paymar y los
estudios de género, se explicará las dinámicas en las que se presenta el control
económico y su interacción con otros tipos de violencia, como parte de los contextos de
violencia sufridos por las mujeres, cuyo abordaje trasciende la mera clasificación aislada
de los hechos en cuatro tipos de violencia; para posteriormente analizarlo desde el punto
de vista jurídico y, en ese marco, plantear y fundamentar que el control económico, como
forma de violencia económica o patrimonial, atenta y vulnera múltiples derechos
humanos, cuyo goce y protección deben ser garantizados por el Estado, a través del
acceso al sistema de justicia. / This thesis will examine the identification and approach provided by the National Police
of Peru, the Public Ministry and the Judiciary regarding economic control in intimate
relationships as a form of gender-based violence against women, in the attention of
judicialized complaints for physical and psychological violence in the city of Arequipa,
within the framework of Law No. 30364, Law to prevent, punish and eradicate violence
against women and members of the family group and in light of the right of access to
justice.
Based on the theory of the wheel of power and control by E. Pence and M. Paymar and
gender studies, the dynamics in which economic control is presented and its interaction
with other types of violence will be explained, as part of the contexts of violence suffered
by women, whose approach transcends the mere isolated classification of the events
into four types of violence; to later analyze it from the legal point of view and, in that
framework, propose and substantiate that economic control, as a form of economic or
patrimonial violence, attempts and violates multiple human rights, whose enjoyment and
protection must be guaranteed by the State, to through access to the justice system.
