Por medio del presente trabajo, se realizará un análisis sobre la inscripción en Registros
Públicos de los actos jurídicos sujeto a condición suspensiva, en específico, nos referimos
a aquellos actos que tendrán trascendencia por sus efectos reales. Para ello, se desarrollará
el estado de la cuestión a nivel registral, lo cual incluye el contenido de la posición del
acuerdo plenario respecto a la inscripción de los actos jurídicos sujeto a condición
suspensiva, así como también los fundamentos que se desarrollaron en dicho Pleno
Registral. A su vez, se abordará una crítica al Tribunal Registral debido a la ausencia de
una evaluación y análisis de la clasificación de la condición suspensiva en sus
Resoluciones Registrales, lo cual tiene un impacto en la susceptibilidad de la inscripción
del acto en cuestión – en la medida que la condición suspensiva podría responder a ser
nula-. Por último, brindaré mi posición al respecto y, más bien, cómo podría abreviarse
los procesos de inscripción de los actos jurídicos sujeto a condición suspensiva mediante
el establecimiento de un precedente de observancia obligatoria.
Cabe indicar que, en el presente trabajo se ha utilizado la metodología de investigación
dogmática, analítica, y sistemática, para cada una de las partes de este documento, con la
finalidad de lograr una investigación integral / By this work, an analysis will be carried out on the registration in Public Registries of
legal acts subject to suspensive conditions, specifically, we refer to those acts that have
real effects. For the purpose of this work, we are going to develop about the state of the
question, which includes the content of the position of the plenary agreement regarding
the registration of legal acts subject to suspensive condition, as well as the reasons that
were developed. In addition, I will make a criticism respect the absence of the evaluation
and analysis of the classification of the suspensive condition in the Resolutions, which
has an impact on the susceptibility of the registration of the act. Finally, I will offer my
position on the matter.
It should be noted that, in the present work, the dogmatic, analytical, and systematic
research methodology has been used for each of the parts of this document.
