A perspectiva da justiça ambiental e suas implicações jurídicas delimitam o objeto da presente investigação. O objetivo central foi analisar a desconexão teórica existente entre as perspectivas da justiça ambiental e da justiça ecológica, bem como a possibilidade de edificar uma concepção unitária e ampliada de justiça ambiental (e ecológica), extraindo dessa ampliação conceitual implicações jurídicas. Trata-se de pesquisa de natureza analítica, cujo corte epistemológico adotado foram teorias da justiça capazes de fornecer substrato teórico necessário para a construção de uma noção ampla de justiça ambiental. A adoção de uma concepção de justiça voltada à realização do bem comum permitiu identificar modernas abordagens da justiça que demonstram que a justiça ambiental não compreende apenas demandas redistributivas, mas também demandas por reconhecimento social e respeito às capacidades essenciais ao florescimento da vida em todas as suas formas. À luz dessas modernas teorias tornou-se possível identificar as dimensões da justiça ambiental (intrageracional, intergeracional e interespécies). A identificação das dimensões da justiça ambiental permitiu compreendê-la como um conceito amplo e unitário, porém tridimensional no tocante aos destinatários de considerações de justiça, bem como que a justiça ambiental acarreta não apenas obrigações de cunho moral, mas também jurídico. Direitos e deveres humanos e fundamentais de cunho ecológico, a partir dessa perspectiva tridimensional da justiça ambiental redefinem e reformulam velhos dogmas jurídicos de outrora, bem como reorientam a edificação de um novo modelo de Estado (Socioambiental e Democrático) de Direito. / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The perspective of environmental justice and its legal implications delimits the subject of the present investigation. The main goal was to exame the theoretical disconnection between the perspectives of environmental justice and ecological justice, and the possibility of building an unitary and expanded concept of environmental justice (and ecological), then extracting of this conceptual expansion legal implications. It is likely analytical research, which were adopted epistemological theories of justice capable of providing theoretical background necessary for the construction of a major notion of environmental justice. The adoption of a conception of justice aimed at achieving the common welfare identified modern justice approaches to demonstrate that environmental justice is not simply redistributive demands, but also demands for social recognition and respect for the essential capabilities to the bloom of life in all its forms. In the light of modern theories became possible to identify the dimensions of environmental justice (intragenerational, intergenerational and interspecies). The identification of the dimensions of environmental justice has allowed us to understand it as a major and unitary concept, but three-dimensional to those who are destinatary of justice, as well as the environmental justice entails not only of moral obligations, but also legal. Rights and duties of fundamental human and ecological, from that three-dimensional perspective of environmental justice redefines and reshapes old legal dogmas of the past, and reorient the building of a new rule (environmental and democratic) of law.
