Previous issue date: 2009-10-19 / This work aims to examine the new demands that the Brazilian legal
education is facing in the present time, called post-modern, which groups a series of
structural transformation and changes that has occurred in world society, especially
after the second world war.
From a philosophical and historical perspective, we start from the hypothesis
that Post-modernity brings along with itself new demands for Brazilian legal
education and represents a challenging time to encourage reflection on the meaning
and the role of this courses in this new scenario.
The route starts from the description, in the first chapter of the characteristics
of Post modernity, for then examine the proposals of the State, expressed in the
curriculum, over the almost 200 years of legal courses, with particular attention to
new prospects opened with the 1988 Federal Constitution.
The more specific examination of new skills and competencies required for
legal courses and students in the context of Post modernity performed in this work
points to the necessity of a change of the existing paradigms in the formation of
future lawyers, highlighting in particular the adoption of interdisciplinarity as formative
proposal.
We concluded that the great change, nevertheless, resides in the
construction of a new conception on the teaching of the Right, a new mentality, which
process must implicate the whole society, as well as the perception of the new forms
of professional acting, when the passivity and the excessive litigiousness are
surpassed, in order to value other forms of resolution and prevention of conflicts / O presente trabalho tem por objetivo examinar as novas demandas que se
apresentam ao ensino jurídico brasileiro em função do novo tempo vivido,
denominado pós-moderno, que sob esse nome agrupa uma série de transformações
e de mudanças estruturais que vem ocorrendo na sociedade mundial, especialmente
depois da Segunda Guerra Mundial. Com base em uma perspectiva filosófica e
histórica, partimos da hipótese de que a pós-modernidade traz consigo novas
demandas para o ensino jurídico brasileiro e representa um instigante momento para
fomentar a reflexão sobre o sentido e o papel dos cursos jurídicos nesse novo
cenário.
O itinerário percorrido tem início a partir da descrição das características da
pós-modernidade, para, em seguida, examinar as propostas oficiais do Estado,
expressas nos currículos, ao longo dos quase duzentos anos de cursos jurídicos,
dedicando-se especial atenção às novas perspectivas inauguradas com a
Constituição Federal de 1988.
O exame mais específico das novas habilidades e competências
necessárias aos cursos jurídicos e aos estudantes no contexto da pós-modernidade
realizado aponta para a necessidade de uma mudança dos paradigmas existentes
na formação dos futuros juristas, valorizando-se especialmente a adoção da
interdisciplinaridade como proposta formativa.
Conclui-se que a grande mudança, contudo, reside na construção de uma
nova concepção sobre o ensino do direito, uma nova mentalidade, cujo processo
deve implicar toda a sociedade, bem como a percepção de novas formas de atuação
profissional, superando-se a passividade e a litigiosidade excessiva, a fim de
valorizar, cada vez mais, outras formas de resolução e prevenção de conflitos
