Previous issue date: 2012-01-04 / This thesis, linked to the area of concentration: Constitutional Foundations of Public Law and Private Law, the Graduate Program in Law at the Catholic University of Rio Grande do Sul, defends the fundamentality of the right to sustainable city and examines aspects theoretical and dogmatic. A city will only be sustainable if all public and private property have their proper destination in terms of socio-environmental, urban policy should be submitted to the participatory control. The main objective of the research was to determine the principal reason for this law, as well as its content and structure. The objective was to also analyze the right to a truly sustainable city as a fundamental right socio complete, ie, composed of a bundle of rights and defensives duties. Since then, eight legal indicators were appointed for measuring the sustainability of a city. For the analysis of the proposed research questions were addressed issues related to the theory of fundamental rights and its effectiveness, the right to property and right to the city, the phenomenon of urbanization and its social, political and legal, the City Statute and justicializa??o the fundamental right to a sustainable city. The development of research methodology employed a multidimensional, covering the analytical dimension - through the presentation of the basic concepts necessary to understand the intersubjective field, the empirical dimension - especially with the analysis of historical facts, understandings and jurisprudential texts, the normative dimension - critical The practice, held on the grounds of the other dimensions. Theoretical frameworks regarding the research were mainly Robert Alexy, Ronald Dworkin, Hans-Georg Gadamer, Juarez Freitas, Ingo Wolfgang Sarlet, e Ving?lio Afonso da Silva. / A presente tese, vinculada ? ?rea de concentra??o: Fundamentos Constitucionais do Direito P?blico e do Direito Privado, do Programa de P?s-gradua??o em Direito da Pontif?cia Universidade Cat?lica do Rio Grande do Sul, defende a fundamentalidade do direito ? cidade sustent?vel e analisa seus aspectos te?ricos e dogm?ticos. Uma cidade s? ser? sustent?vel se todos os bens p?blicos e privados tiverem a sua destina??o adequada em termos socioambientais, devendo a pol?tica urbana ser submetida ao controle participativo. O objetivo principal da investiga??o foi verificar a fundamentalidade do direito ? cidade sustent?vel, seu conte?do e sua estrutura, como um aut?ntico direito fundamental socioambiental em toda extens?o (completo). Ou seja, ? um direito fundamental composto por um feixe de direitos defensivos e prestacionais. A partir de ent?o, foram apontados oito indicadores para a aferi??o jur?dica da sustentabilidade de uma cidade. Para a an?lise das quest?es de pesquisa propostas, foram enfrentados temas relacionados ? teoria dos direitos fundamentais e a sua efic?cia, o direito de propriedade e o direito ? cidade, o fen?meno da urbaniza??o e suas consequ?ncias sociais, pol?ticas e jur?dicas, o Estatuto da Cidade e a justicializa??o do direito fundamental ? cidade sustent?vel. O desenvolvimento da investiga??o empregou uma metodologia multidimensional, abrangendo a dimens?o anal?tica por meio da apresenta??o dos conceitos b?sicos necess?rios ? compreens?o intersubjetiva da mat?ria; a dimens?o emp?rica especialmente com a an?lise de fatos hist?ricos, textos legais e entendimentos jurisprudenciais; a dimens?o normativa cr?tica ? pr?xis, realizada com base nos fundamentos das outras dimens?es. Os referenciais te?ricos que ampararam a pesquisa foram principalmente Robert Alexy, Ronald Dworkin, Hans-Georg Gadamer, Juarez Freitas, Ingo Wolfgang Sarlet e Virg?lio Afonso da Silva.
