Previous issue date: 2017 / Entre o fim do século XIX e o início século XX ocorreu o grande declínio do modelo de Estado liberal até então dominante. Cresceram as teorias do Estado autoritário com vistas a reelaborar a noção de separação de poderes existente, defendendo o fortalecimento do poder executivo. Neste cenário, aparece Costantino Mortati (1891-1985), um nome influente no direito constitucional italiano. Sua teorização sobre a funzione del governo propõe um rearranjo das funções do Estado de forma a convertê-las em um único polo, que reflete os desejos e anseios sociais e unifica sociedade e Estado. Assim, o conjunto dos valores e princípios substanciais da sociedade que dão fundamento ao ordenamento jurídico é representado pela costituzione materiale entendida como orientação política fundamental. Neste sentido, o primeiro capítulo do presente trabalho se volta a descrever a teoria de Costantino Mortati. Num segundo momento, utilizando-se do método dedutivo de abordagem e da análise da doutrina, serão explorados dois períodos históricos-constitucionais do Direito brasileiro: a Primeira República, baseando-se em Alberto Torres nas obras O problema nacional brasileiro e A organização nacional , bem como o período do Estado Novo, baseando-se em Francisco Campos na obra O Estado Nacional . Em suma, o escopo do presente trabalho consiste em verificar, a partir das duas construções elaboradas por Costantino Mortati nos anos 30 função de governo e constituição material como se estruturou a reflexão sobre a organização estatal e constitucional no Brasil da primeira metade do século XX. / Abstract: Between the end of the nineteenth century and the beginning of the twentieth century took place the great decline of the liberal state model dominant at the time. The theories of the authoritarian state were expanded in order to rework the notion of separation of powers, defending the strengthening of the executive power. In this scenario, comes up the name of Costantino Mortati (1891-1985), an influential author in Italian constitutional law. His theorizing about the funzione del governo proposes a rearrangement of the functions of the State in a way that converts them into a unique pole, which reflects the desires and social yearnings and unifies society and State. Thus, the set of values and substantial principles of society that underlie the legal system is represented by the costituzione materiale , understood as a fundamental political orientation. In this sense, the first chapter of the present study aims to describe the theory of Costantino Mortati. In a second moment, using the deductive method of approach and analysis of doctrine, two historical-constitutional periods of Brazilian law will be explored: the First Republic, based on Alberto Torres in the works The Brazilian national problem and A National organization , as well as the period of the New State, based on Francisco Campos in the work The National State . In conclusion, the scope of the present work consists of verifying, from the two constructions elaborated by Costantino Mortati in the 30 s function of government and the material constitution how was structured the reflection on the constitutional and governmental organization in Brazil during the first half of the twentieth century.
