Previous issue date: 2014-12-19 / This research is in the line of research of contemporary legal and penal systems, linked with the concentration area of Penal System and Violence which addresses the relationship between the International Legal Cooperation and Criminal Sciences. The development involves the breaking of conceptual paradigms involving the phenomenon of globalization and its effects on reframing concepts such as sovereignty, border and territory, in the specific context of MERCOSUL. Also in the context of contemporary changes, the International Legal Cooperation suffered a considerable increase in their mechanisms, responding to the desires of the reality of the expansion of transnational crime, developing new ways to be effective in practice. In the regional context, it was through the San Luis Protocol, an international standard that regulates the activity of cooperation in criminal matters and binds all the MERCOSUL countries. There was no express provision in the fundamental rights and guarantees protection protocol, although there is expected - the generic guarantee of public order - the possible route of formation of these rights at the regional level is based on a systematic incidence of the American Convention on Human Rights - ACHR. The agreement is part of the inter-american human rights system and is currently in force in all countries of the MERCOSUL with the exception of Venezuela. / A presente investiga??o se situa na linha de pesquisa de sistemas jur?dico-penais contempor?neos, vinculada ? ?rea de concentra??o Sistema penal e Viol?ncia, onde aborda a rela??o entre a Coopera??o Jur?dica Internacional e as Ci?ncias Criminais. O desenvolvimento passa pela quebra de paradigmas conceituais envolvendo o fen?meno da globaliza??o e seus reflexos na ressignifica??o de conceitos como soberania, fronteira e territ?rio, no contexto espec?fico do MERCOSUL. Ainda acerca dessas mudan?as contempor?neas, a Coopera??o Jur?dica Internacional sofreu um consider?vel incremento nos seus mecanismos, que respondendo aos anseios da realidade da expans?o da criminalidade transnacional, desenvolveu novas formas para se efetivar concretamente. No caso regional, isso se deu por meio do Protocolo de San Luis, norma internacional que regula a atividade de coopera??o em mat?ria penal e vincula todos os pa?ses do MERCOSUL. Inobstante n?o haver previs?o expressa no protocolo de prote??o aos direitos e garantias fundamentais, embora exista previs?o ? gen?rica da garantia da ordem p?blica -, a via poss?vel de conforma??o desses direitos no ?mbito regional ? a partir da incid?ncia sistem?tica da Conven??o Americana de Direitos Humanos ? CADH. A conven??o integra o sistema interamericano de direitos humanos e atualmente est? em vigor em todos os pa?ses parte do MERCOSUL com a exce??o da Venezuela.
