São analisados o contexto do surgimento do conceito de dumping e das medidas antidumping, bem como da regulamentação multilateral sobre a matéria. É apresentada uma análise detalhada do texto do artigo 2 do Acordo Antidumping , em que são avaliadas as orientações do Acordo acerca da apuração da margem de dumping. Esse estudo detalhado viabiliza o levantamento das deficiências presentes no texto do Acordo, explicitada, também, por meio de diversas decisões do Sistema de Solução de Controvérsias da Organização Mundial do Comércio. Busca-se identificar as causas das deficiências presentes no texto do Acordo Antidumping e analisar as suas conseqüências. _______________________________________________________________________________________ ABSTRACT / This study explores the deficiencies and imprecision of article 2 of the Antidumping Agreement. It is aimed at analyzing the context of the developing of the concept of dumping and the beginning of the use of antidumping measures. The main contribution of this study will be the detailed examination of the antidumping duties rules in the Multilateral Trade System, specifically regarding the article 2 of the Antidumping Agreement related to dumping margins calculations. This effort is understood to be a pre-condition to identify the deficiencies observed in article’s 2 text, which are exposed also by the decisions of the Dispute Settlement System of World Trade Organization. Furthermore, the analysis searches to present the causes of these deficiencies and its consequences.
