El presente trabajo de investigación titulado “La cuota de empleo de personas con discapacidad y su incidencia en el mercado laboral peruano” tiene como objetivo identificar los aspectos que podrían afectar la adecuada implementación, en el ámbito empresarial, de la Ley N° 29973, Ley General de la Persona con Discapacidad (en adelante LGPD), que entró en vigencia el 25 de diciembre de 2012, y su Reglamento (en adelante el Reglamento) aprobado por Decreto Supremo N° 002-2014-MIMP, el 09 de abril de 2014 (Decreto Supremo N° 002-2014-MIMP).
El documento se desarrolla de la siguiente manera: en el capítulo I se explica el problema de investigación, justificación, objetivos, alcances y limitaciones, hipótesis, y metodología; en el capítulo II, titulado Marco teórico, se explican el concepto de discapacidad según diversos organismos internacionales, la importancia del empleo para la inclusión de personas con discapacidad (PCD) en la sociedad, el sistema de cuotas de empleo, y las estadísticas de la PCD. En el capítulo III se analiza la legislación peruana en el tratamiento de las personas con discapacidad, especialmente la Constitución Peruana de 1993, la Ley N° 29973, LGPD, y su Reglamento (Decreto Supremo N° 002-2014-MIMP), así como las acciones de fiscalización, multas y sanciones. En el IV capítulo se analiza la experiencia internacional del sistema de cuotas en Ecuador y España, y se finaliza con el capítulo V, donde se presentan propuestas de mejora para la aplicación de la cuota de empleo en el Perú. / The present research work entitled "The mandatory employment share of people with disabilities and their impact on the Peruvian labor market" aims to identify the aspects that could affect the adequate implementation of Law N ° 29973 - General Law of the Person with Disability (hereinafter LGPD) regarding the private sector. The LGPD entered into force on December 25, 2012, and its Regulations (hereinafter the Regulations) were approved by Supreme Decree No. 002-2014-MIMP, on April 9, 2014 (Decree Supreme No. 002-2014-MIMP).
This document have been developed as follows: Chapter I explains the problem of research, justification, objectives, scope and limitations, hypothesis, and methodology; In Chapter II, entitled Theoretical Framework, the concept of disability is explained according to various international organizations, the importance of employment for the inclusion of persons with disabilities (PCD) in society, the system of mandatory employment shares, and the statistics of the PCD. Chapter III discusses Peruvian legislation in the treatment of persons with disabilities, especially the Peruvian Constitution of 1993, Law No. 29973, LGPD, and its Regulation (Supreme Decree No. 002-2014-MIMP), as well as the control actions, fines and sanctions. The chapter VI analyzes the international experience of the mandatory share system in Ecuador and Spain, and ends with Chapter V, where proposals for improvement are presented for the application of the mandatory employment share in Peru. / Tesis
