Previous issue date: 2017-01-23 / The thesis presented has as topic of study the discourses about the feminine figure in the Brazilian?s penitentiary system, using the epistemological framework of Michel Foucault (2008) in order to accomplish the discourse analysis which was proposed. Therefore, the methodology used was based on documental analysis and bibliographic research. The thesis analysis was characterized in the political-normative instruments defined by the Brazilian State, which tries to guarantee rights to the women imprisoned. Also, a bibliographical research accompanied the study in order to elucidate how the first propositions of penitentiary policies destined to women of the 20th century were built. The thesis is based on theoretical references from critical criminology, feminist criminology and gender relations. The results obtained indicate that, even a century after the installation of prisons for women in Brazil, in discursive terms and normative concepts based on the gender relations, there are still regularities which indicates that women's criminal execution and the proposition of politics in such a context, is mediated by stereotypes and normative concepts around gender relations, whereby the female body is produced around motherhood. This is because, the documents analyzed indicate that women must have their specificities respected in the context of prison and also, joy of the appropriate conditions to their incarceration. If in the 20th century the specificities were defined through the discursive formations which built the imaginary for the criminal woman, as a crazy and failed mother, receiving as an appropriate punishment religious teachings by a religious congregation which was entrusted of this mission; In current discourses the specificity revolves around motherhood and the spaces defined as suitable for the imprisonment of women are those that must contain spaces for them to remain with their children. That said, the thesis is defending that the imprisoned women only acquires visibility before the public sphere, from its condition as potential mother. / A tese ora apresentada teve por tema de estudo os discursos sobre o feminino na quest?o penitenci?ria brasileira, utilizou-se do referencial epistemol?gico de Michel Foucault (2008) de modo a realizar a an?lise de discurso a qual se prop?s. Para tanto, a metodologia utilizada baseou-se em an?lise documental e pesquisa bibliogr?fica. O corpus de an?lise da tese caracterizou-se nos instrumentos pol?tico-normativos definidos pela Estado Brasileiro, os quais intentam assegurar direitos ?s mulheres em situa??o de pris?o. Do mesmo modo, realizou-se uma pesquisa bibliogr?fica afim de elucidar como foram constru?das as primeiras proposi??es de pol?ticas penitenci?rias destinadas ?s mulheres no s?culo XX. A tese est? alicer?ada em refer?ncias te?ricos oriundos da criminologia cr?tica, da criminologia feminista e das rela??es de g?nero. Os resultados obtidos apontam que, mesmo ap?s quase um s?culo de institui??o das pris?es femininas no Brasil, em termos discursivos e conceitos normativos com base nas rela??es de g?nero, ainda comparecem regularidades encunciativas que apontam na dire??o de que a execu??o penal de mulheres e a proposi??o de pol?ticas em tal contexto, ? mediada pelos estere?tipos e conceitos normativos em torno das rela??es de g?nero, pelos quais, o corpo feminino ? produzido a partir da maternidade. Isto porque, os documentos analisados sinalizam que as mulheres devem ter suas especificidades respeitadas no contexto da pris?o e ainda, usufru?rem de condi??es adequadas ao seu encarceramento. Se no s?culo XX as especificidades foram definidas por meio de forma??es discursivas que constru?ram o imagin?rio da mulher criminosa, como louca e m?e falha, recebendo como puni??o adequada ensinamentos religiosos por parte de uma congrega??o religiosa que se incumbiu desta miss?o; nos discursos atuais a especificidade gira em torno da maternidade e os espa?os definidos como adequados ao aprisionamento de mulheres s?o aqueles que devem conter espa?os para que permane?am com seus filhos e filhas. Isto posto, defende-se a tese de que a mulher em situa??o de pris?o somente adquire visibilidade perante a esfera p?blica, a partir de sua condi??o enquanto m?e em potencial.
