A dissertação promove uma abordagem histórica acerca do ensino jurídico, perpassando pelos desafios emergentes na época atual e, por fim, discorrendo dos fatores e das transformações já vivenciadas, bem como, as que surgem como fundamentais à formação do jurista na contemporaneidade. A pesquisa visa à identificação dos fatores que sustentaram as crises no ensino jurídico ao longo dos anos, bem como, os que efetivamente devem ser combatidos neste século. Essas questões são analisadas com a utilização do método dedutivo, partindo-se da identificação de uma teoria histórica acerca do ensino jurídico, para após, promover a descrição dos desafios modernos enfrentados pela comunidade acadêmica no que se refere ao efetivo e qualitativo ensino jurídico. A partir do contexto histórico, analisam-se temas emergentes e de forte influência à formação jurídica, tais como os conflitos coletivos e transindividuais, interdisciplinaridade dos conhecimentos, o Direito do Ambiente, as formas extrajudiciais de resolução de conflitos como meio igualmente legítimo de acesso à justiça, os direitos humanos, a tolerância, o multiculturalismo e a cidadania. Por fim, examinam-se as principais transformações referentes à educação neste século, abordando os aspectos percebidos como de maior relevância ao ensino jurídico brasileiro e à formação de um profissional da área jurídica efetivamente preparado para enfrentar esse século. Conclui-se que o ensino do direito está vivenciando as inovações trazidas pelo mundo moderno, sem ter superado as crises que se estenderam ao longo da história dos cursos jurídicos no Brasil. Deste modo, a pesquisa e a reflexão acerca dos caminhos a serem percorridos, os desafios a serem enfrentados, bem como, as atitudes que devem desde logo tornar-se realidade, são fatores indispensáveis à superação dos desafios identificados durante a pesquisa. Após refletir acerca da pluralidade e universalidade de informações trazidas pela globalização, percorrendo da história à contemporaneidade, adentrando nos pensamentos de grandes autores, é que se chegou a perceber referências fundamentais ao ensino jurídico: a dialética, o devir, a consciência universal de que somos responsáveis por aquilo que a humanidade almeja, individualmente e coletivamente. / The object of this present paper is to identify the challenges related to the formation of the professional Law from the XXI century.The dissertation promotes a historical approach about the legal teaching, going through the emerging challenges in the current epoch and at the end, expatiating about the factors and transformations already experienced, as well as, the ones which arise as fundamental to the jurist#s graduation nowadays. The research aims the identification of factors which must be fought in this century. These questions are analyzed using the deductive method, going from the identification of a historic theory about the legal teaching and after promoting the modern challenges# description faced for academic community referring to the efective and qualitative legal teaching. From the historical context, emerging themes and with strong influence in the legal formation are analysed, like the collective and transindividual, knowledge interdisciplinarity, Enviromental Law, the extrajudicial ways of solving conflicts as a equally legitimate means from acess to the justice, the human rights, the tolerance and the multiculturalism and the citizenship. Ultimately, the main transformations referring to education in this century are examined, approaching the noticed aspects that have much more relevance to the brazilian legal teaching to a professional#s graduation from the Legal area effectively prepared to face this Century. It is concluded that Law schools are experiencing innovations brought from the modern world, without overcoming the crises that were extended along the law courses# history in Brazil. Thereby, the reserch and reflexion about the ways to be walked, the challenges to be faced, as well as, the attitudes that must be true from now on, are important factors for the overcoming of identified challenges during the research. After reflecting about the plurality and universality of information brought from the globalization going from the history until the contemporaneity, getting inside the great authors# thoughts, the fundamental reference to the legal teaching is finally noticed: the dialectical, the future changings, the universal conscious that we are responsible for what the mankind wants, individually or collectively.
