Previous issue date: 2015 / Nesta tese parte-se da hipótese de que, em decorrência do processo de redemocratização, novas estruturas de oportunidade política e novos canais institucionais para mobilização estão disponíveis para as organizações da sociedade civil, como a abertura do poder Judiciário para defesa dos direitos difusos e coletivos, por meio de instrumentos como a ação civil pública (ACP). Facultada a utilização desse instrumento como recurso estratégico e simbólico de luta política, caberia às organizações da sociedade civil transformar a oportunidade em realidade, de modo que esse recurso potencial possa tornar-se real. Assim, propusemo-nos a identificar os principais fatores condicionantes para a utilização da ACP pelas organizações, a fim de compreender como e por que as associações integram a ACP em seu repertório de ações, recorrendo à estratégia da mobilização legal para solução de suas demandas. A base empírica para o presente estudo é o contexto do estado de Santa Catarina, as ACPs ajuizadas no período 2004-2008 e as organizações da sociedade civil autoras das referidas ações. A tese orienta-se por questões que tratam do contexto que veio a influenciar a trajetória política do associativismo civil de Santa Catarina: quais as razões que levaram as organizações da sociedade civil a escolher a ACP em seu repertório de ações, recorrendo à estratégia da mobilização legal? O recurso à ACP faz parte de um contexto de lutas políticas? Como a ACP e o espaço judicial são percebidos no imaginário das organizações? Tais questões versam, portanto, sobre o vínculo sociológico existente entre as estruturas sociais dadas e as práticas dos agentes sociais. O debate aqui construído e os resultados obtidos reforçam a literatura que aborda os efeitos das mudanças nas estruturas de oportunidades políticas; que analisa a mobilização do Direito pela sociedade civil e que estuda as práticas associativas no contexto do estado de Santa Catarina. Evidenciou-se que em Santa Catarina, diante de um número significativo de ACPs ajuizadas por entes da sociedade civil, o instrumento da ACP revela-se uma oportunidade política de fato. O sucesso no ajuizamento atua como efeito demonstrativo para muitas organizações e, além disso, aparece como ficha simbólica de negociação. Evidenciou-se também que novas organizações surgem a partir da oportunidade política citada, assim como que as ACPs fazem parte de um repertório de confronto político. A ACP possui uma relação com a lógica mobilizatória das organizações da sociedade civil, tratando-se, portanto, de uma forma por meio da qual os atores sociais organizam sua experiência, sendo mais um elemento da mobilização e de ação política.<br> / Abstract : This thesis is based on the hypothesis that as a result of the process of redemocratization, new structures of political opportunity and new institutional channels for mobilization were made available to organizations of civil society, with the opening of the Judiciary for the defense of diffuse and collective rights, through instruments such as Public Civil Action. With the availability of this instrument as a strategic and symbolic resource of political struggle, it is the responsibility of the organizations of civil society to transform the opportunity into a reality, so that this potential resource becomes real. Thus, we propose to identify the three factors that determine the use of ACP by organizations, in order to understand how and why associations integrate ACP into their repertoire of actions, using the strategy of legal mobilization. The empirical basis for this study is the context of the state of Santa Catarina, the ACP judged in the period 2004-2008, and the organizations of civil societies that filed the lawsuits in question. The thesis is guided by questions relating to the context that influences the political trajectory of civil associativism of Santa Catarina, such as the factors that lead organizations of civil society to choose ACP in their repertoire of actions, whether the resource of ACP is part of a context of political struggles, and how ACP and the judicial space are perceived in the imagination of organizations. They therefore address the sociological link that exists between the given social structures and the practices of the social agents. The debate constructed here, and the results obtained, reinforce the literature that addresses the effects of changes in the structures of political opportunities; that analyzes the mobilization of the law by civil society and; that studies the associative practices in the context of the state of Santa Catarina. It demonstrated that in Santa Catarina, faced with a significant number of ACPs judged by entities of civil society, the instrument of ACP reveals a political opportunity of fact. The success of the judgment acts as a demonstrative effect for many organizations. Furthermore, it appears as a symbolic record of negotiation. It was also demonstrated that new organizations emerge based on the above mentioned political opportunity, and also that ACPs are part of a repertoire of political confrontation, and have a relationship with the mobilizing logic of organizations of civil society. They therefore deal with the way through which social actors organize their experience, providing another element of mobilization and political action.
