En el presente informe, se realizará el análisis sobre el contenido del acto
administrativo, dentro de un procedimiento de modificación de un instrumento de
gestión ambiental (IGA). En base a ello, como parte del presente trabajo, se plantea que
la no vinculación entre el cumplimiento de las obligaciones de un instrumento de
gestión ambiental y el procedimiento de modificación del mismo, y la falta de
continuidad de análisis de los mecanismos de información y participación ciudadana
dentro de la evaluación de modificación del IGA podrían generar una afectación en los
derechos humanos de la población relacionada al proyecto.
Adicionalmente, como parte del análisis, se determinará que incluir el análisis del
estado de las obligaciones de un instrumento de gestión ambiental y los mecanismos de
información y participación ciudadana, relacionado a la realización e implementación,
son vitales a efectos de que el contenido del acto administrativo tenga un enfoque de
derechos humanos. Asimismo, se planteará una propuesta de reforma normativa que
posibilite la vinculación entre la ejecución de las obligaciones contenidas en el
mecanismo ambiental inicial y la modificación del mismo.
Para sustentar las conclusiones planteadas, se realizará un estudio normativo sobre el
contenido del acto administrativo en el marco de una modificación de un instrumento de
gestión ambiental. Analizándose para ello el principio de legalidad, y sus alcances, el
cual será profundizado con un análisis doctrinario sobre sus alcances, contrastado con
un enfoque de derechos humanos. De igual forma, se realizará un estudio doctrinario
sobre los mecanismos de información y participación ciudadana, y su finalidad. El cual
se contrastará con su regulación en el marco de emergencia sanitaria. / In this report, an analysis will be made of the content of the administrative act, within a
procedure of modification of an environmental management instrument (IGA). Based
on this, as part of this work, it is proposed that the lack of linkage between compliance
with the obligations of an environmental management instrument and its modification
procedure, and the lack of continuity in the analysis of the information and citizen
participation mechanisms within the evaluation of the modification of the IGA could
generate an impact on the human rights of the population related to the project.
Additionally, as part of the analysis, it will be determined that including the analysis of
the status of the obligations of an environmental management instrument and the
mechanisms of information and citizen participation, related to the realization and
implementation, are vital in order for the content of the administrative act to have a
human rights approach. Likewise, a proposal will be put forward for a normative reform
that makes possible the link between the execution of the obligations contained in the
initial environmental mechanism and the modification of the same.
In order to support the proposed conclusions, a normative study will be carried out on
the content of the administrative act within the framework of a modification of an
environmental management instrument. For this purpose, the principle of legality and its
scope will be analyzed, which will be deepened with a doctrinal analysis of its scope,
contrasted with a human rights approach. Likewise, a doctrinal study will be made on
the mechanisms of information and citizen participation, and their purpose. This will be
contrasted with its regulation in the sanitary emergency framework.
