Freedom, the study subject of this PhD thesis, has always been pillar of Law and predilection for philosophy. In this research, further the Philosophy of Law, in association with the Philosophy in Law.
Therefore, this work brings, at first, the problem involving the freedom in our times, and methodological postulates that form this thesis: the Jus-normative humanism and the Humanist Capitalism with the strengthening of the Theory Imaginary of Law (and of Totality). Later we shall make an analysis about the variations of the concept of freedom in Western History.
We shall see that the concept of freedom is absolutely inseparable from the world view in which it is inserted, and it is closely related to the political-economic system which arises in each historical period.
In the Homeric universe, freedom is a purely political attribute assigned to only a tiny portion of the population - citizens, in the Christian universe, freedom translates itself in free will, while in the Newtonian universe, freedom is merely formal.
The new concept of Freedom that we propose in this thesis takes as postulates the great ladies of Greek Mythology - Aphrodite, Themis, Athens and Demeter - that is, a concept of freedom that comes from the beautiful, the just, the wise and fruitful to formulate a Freedom of conscience of the coexistence, within a quantum view, either imaginary of the world, in a systematic legal and economic guided by the ideals of Humanist Capitalism.
We believe that Law should be an instrument of realization of love and not a mere instrument of domination of man and the planet by man. This thesis was written in this spirit! / O Direito é uma ciência conjectural que deve ser estudada de forma associada com as demais áreas do conhecimento. A Liberdade, objeto de estudo desta tese de doutoramento, desde sempre foi tema pilar do Direito e de predileção para a filosofia. Nesta pesquisa, para além da Filosofia do Direito, associamos a Liberdade com a filosofia no Direito.
Para tanto, este trabalho traz, num primeiro momento, a problemática que envolve a liberdade hodiernamente e os postulados metodológicos nos quais se inserem esta tese: o Jus-humanismo normativo e o Capitalismo Humanista, com o reforço da Teoria Imaginária do Direito e da Totalidade. Em seguida, faz-se uma análise quanto às variações do conceito de liberdade na história ocidental.
O conceito de liberdade é absolutamente indissociável da visão de mundo no qual está inserido, bem como está intimamente relacionado com o sistema político-econômico do qual decorre em cada período histórico.
No universo homérico, a liberdade é um atributo meramente político atribuído a apenas uma ínfima parcela da população aos cidadãos; no universo cristão, a liberdade se traduz em livre-arbítrio; ao passo que no universo newtoniano, a liberdade é meramente formal.
O novo conceito de Liberdade que propomos nesta tese toma como postulados as grandes damas da mitologia grega Afrodite, Têmis, Atenas e Deméter ou seja, é um conceito de liberdade que parte do belo, do justo, do sábio e do fecundo a fim de concretizar uma Liberdade de consciência da coexistência, dentro de uma visão quântica, senão imaginária de mundo, numa sistemática jurídico-econômica pautada nos ideais do Capitalismo Humanista.
Acreditamos que o Direito deva ser um instrumento de concretização do amor e não um mero instrumento de dominação do homem e do Planeta pelo homem. Esta tese foi escrita sob este espírito!
