El incremento de las actividades mineras en el Perú y el mundo se ha producido de modo
acelerado en las últimas décadas, como resultado de la dinámica de la economía mundial
y el surgimiento de nuevos actores económicos globales como China. Esas actividades
se han extendido hasta las líneas de frontera, siendo motivo de preocupación por los
eventuales riesgos que dichas operaciones implican y por los impactos y daños que
podrían tener en el bienestar de las personas y el ambiente en el territorio del otro país.
Por ese motivo, hacemos un análisis de la decisión adoptada en el caso entre Costa Rica
y Nicaragua por la Corte Internacional de Justicia y la Opinión Consultiva emitida por la
Corte Interamericana de Derechos Humanos a pedido de Colombia, a la luz de cuyos
criterios analizamos el caso del proyecto minero Pucamarca y la necesidad de ampliar el
alcance de los instrumentos de gestión ambiental a las actividades de frontera e impactos
en el territorio del otro país. / The increase in mining activities in Peru and the world has occurred rapidly in recent
decades, because of the dynamics of the world economy and the emergence of new
global economic actor such as China. These activities have extended to the border lines,
being a cause for concern for the possible risks that such operations imply and for the
impacts and harms they could have on the well-being of people and the environment in
the territory of the other country. For this reason, we analyze the decision adopted in the
case between Costa Rica and Nicaragua by the International Court of Justice and the
Advisory Opinion issued by the Inter-American Court of Human Rights at the request of
Colombia, considering whose criteria we analyze the case of the Pucamarca mining
project and the need to expand the scope of environmental management instruments to
border activities and impacts on the territory of the other country.
