Orientador: Theresa Maria de Freitas Adrião / Banca: Pedro Ganzeli / Banca: Raquel Fontes Borghi / Resumo: A presente pesquisa, financiada pela Fundação de Amparo à Pesquisa do Estado de São Paulo (Fapesp), objetiva a caracterização, na legislação brasileira, das instituições privadas sem fins lucrativos, com o foco nos institutos. O período retratado no estudo se dá do início da República no Brasil até o ano de 2002. Primeiramente, objetivou-se identificar e caracterizar o chamado Terceiro Setor. Em seguida, identificou-se dentro do período republicano dispositivos das Constituições Federais, além de leis ordinárias e leis complementares, que caracterizem ou remetam a classificação adotada como instituições privadas sem fins lucrativos, dando ênfase à caracterização dos institutos. Por fim, objetivou-se caracterizar os institutos dentro do aparato legal brasileiro, tendo em vista a classificação da natureza jurídica do Instituto Ayrton Senna, utilizado como exemplo na pesquisa. Para desenvolver os objetivos adotados utilizou-se como recurso metodológico a revisão bibliográfica de autores da área, pesquisa documental e a realização de entrevistas semi-estruturadas. Os resultados da pesquisa demonstraram que a natureza jurídica das instituições privadas sem fins lucrativos está regulamentada, atualmente na legislação nacional, somente como associações e fundações. Os institutos foram identificados como uma razão social, podendo ter natureza jurídica de uma associação ou fundação / Abstract: This present research, funded by Fundação de Amparo à Pesquisa do Estado de São Paulo (Fapesp), objective to characterization, in the Brazilian legislation, of private and non-profit-making institutions, focusing on institutes. Primarily, aimed to identify and characterize the so-called Third Sector. Then it was, identified within the period of the Federal Constitutions Republican devices, in addition to ordinary laws and complementary laws that characterize or refer to the classification adopted as a private non-profit institutions, emphasizing the characterization of the institutes. Finally, it was aimed to characterize the institutes within the Brazilian legal apparatus in order to classify the legal nature of the Ayrton Senna Institute, the research used as an example. To develop the objectives adopted was used as a methodological review of the authors in the area, documentary research and semi-structured interviews. The results of the research showed that the legal status of private nonprofit institutions are regulated currently under national law, only as voluntary organizations and foundations.
