Previous issue date: 2017 / A divergência jurisprudencial é tema recorrente, cerne de inquietações no direito brasileiro. Nesse contexto, os tribunais superiores desempenham função de extrema importância por serem constitucionalmente incumbidos de zelar pela unidade do direito. Dentro dessa temática, o objetivo deste trabalho é analisar, criticamente, os embargos de divergência na configuração que lhes foi conferida pelo Código de Processo Civil de 2015 (CPC/2015), como meio processual adequado à eliminação dos dissídios jurisprudenciais endógenos aos tribunais superiores. Para a realização de tal escopo, adotou-se o método de abordagem dedutiva e a técnica de pesquisa bibliográfica. O trabalho se subdivide em três capítulos. O primeiro capítulo se dedica a situar a segurança jurídica como fundamento do Estado Constitucional brasileiro, analisando seus efeitos na função jurisdicional, especialmente na perspectiva da calculabilidade e da confiabilidade do direito. O segundo discorre sobre os tribunais superiores (em especial, sobre a função que desempenham no direito brasileiro), explora o conceito de divergência jurisprudencial e trata dos meios recursais aptos a combater os dissídios à luz do direito processual civil brasileiro. Por fim, o terceiro capítulo examina os embargos de divergência como meio apto à supressão de divergências jurisprudenciais internas aos tribunais superiores, abordando suas nuances, à luz do CPC/2015. Cumpridos os objetivos, conclui-se que, a despeito da Lei n. 13.256/2016 (que tornou natimortas importantes previsões consubstanciadas na versão original do CPC/2015), o recurso foi mais bem regulamentado e assumiu maior importância no bojo da nova sistemática processual civil, como meio apto a elidir, em último grau, os dissídios jurisprudenciais, e a conferir univocidade interpretativa ao direito brasileiro.<br> / Abstract : The jurisprudential divergence is a recurring theme, reason of concerns in brazilian law. In this context, the supreme courts play an extremely important role because they are constitutionally responsible for ensuring the unity of law. Within this theme, the objective of this study is to analyze, critically, what is foreseen for the ?embargos de divergência? in the Civil Procedure Code of 2015 (CPC/2015), as the appropriated procedural means to eliminate the endogenous dissidents to the supreme courts. To achieve such a scope, the method of deductive approach was adopted and the bibliographic research system. The paper is subdivided into three chapters. The first chapter focuses on legal security as the foundation of the Brazilian Constitutional State, analyzing its effects on the jurisdictional function, specially from the perspective of calculability and the reliability of the law. The second analyzes the supreme courts (in particular, the role they play in Brazilian law), the concept of jurisprudential divergence, and the means of appeals that are capable to combat dissidents in the light of the brazilian civil procedure law. Finally, the third chapter examines the ?embargos de divergência? as a suitable means to supress the internal jurisprudential divergences from the supreme courts, addressing their nuances in the light of CPC/2015. Achieved the objectives, it`s concluded that despite of the Law n. 13.256/2016 (which made stillborn important predictions found in the original version of CPC/2015), this appeal was improved and assumed greater importance for the new civil procedure system, as an able mean to eliminate, in the last degree, jurisprudential divergence, and to provide an interpretive univocity to Brazilian law.
