Orientador: Silvio José Benelli / Resumo: Com o título 'Sobre a violência no Brasil: questões e problemas para o Direito e a Psicologia’ o trabalho tem o objetivo de, através de uma articulação interdisciplinar entre temas como Criminologia, Justiça de Transição e Psicanálise discutir o fenômeno da violência mediante aparato de Estado em nosso país. Metodologicamente a presente tese parte do estudo das ‘gambiarras’ como descartáveis conceituais, como ‘peskizas indisciplinares’. A partir da guerra como analisador da sociedade, a investigação percorre o passado da história brasileira, procurando desvendar os mecanismos de produção e reprodução da ordem dominante. Sua trajetória se inscreve no estudo do Relatório Final da Comissão Nacional da Verdade, com especial destaque às análises dedicadas aos povos indígenas, particularmente ao que se refere ao povo Guarani-kaiowá no Estado do Mato Grosso do Sul. O recorte teórico estuda os efeitos psicossociais da impunidade por graves violações de Direitos Humanos e dos chamados ‘níveis psicossociais da lei’. Aborda ainda as tecnologias de negação, com seus discursos justificadores e técnicas de negação. A tese ainda discorre sobre a luta pelo Direito a memória, verdade e justiça no processo de transição democrática, fechando os trabalhos numa leitura psicanalítica do problema do poder e da repetição da violência no Brasil. / Abstract: With the title 'About violence in Brazil: issues and problems for Law and Psychology' the work aims to, through an interdisciplinary articulation between themes such as Criminology, Transitional Justice and Psychoanalysis, discuss the phenomenon of violence through state apparatus in our country. Methodologically, the present thesis is based on the study of 'gambiarras' as conceptual disposables, as 'peskizas indisciplinares'. From the war as an analyzer of society, the investigation goes through the past of Brazilian history, seeking to unveil the mechanisms of production and reproduction of the dominant order. Its trajectory is inscribed in the study of the Final Report of the National Truth Commission, with special emphasis on the analyses dedicated to the indigenous peoples, particularly the Guarani-kaiowá people in the State of Mato Grosso do Sul. The theoretical cutout studies the psychosocial effects of impunity for serious human rights violations and the so-called 'psychosocial levels of law'. It also addresses the technologies of denial, with its justifiable speeches and techniques of denial. The thesis also discusses the struggle for the right to memory, truth and justice in the process of democratic transition, closing the work in a psychoanalytical reading of the problem of power and the repetition of violence in Brazil. / Doutor
