Ao longo desta investigação são utilizados os critérios lógico-dialéticos bem peculiares a este filósofo. Nos estudos da filosofia do direito de Hegel, o princípio da liberdade será o conceito fundante e é ele que prepassará todos os momentos lógico-dialéticos da filosofia do direito, desde o direito abstrato até sua máxima realização na Eticidade e, mais especificamente, no Estado. É o Estado, por sua vez, que possibilitará a realização plena do indivíduo, sem, no entanto, aniquilar a família e a sociedade civil-burguesa, pois eles formam a base do Estado. A organização e o envolvimento do cidadão com o Estado é tão profunda que ele se sentirá responsável em assegurar não somente a sua liberdade como também a de cada membro, através da promulgação da Constituição oriunda dos hábitos e costumes de um povo. Neste caso, somente no momento lógico-dialético do Estado é que o cidadão se sentirá plenamente livre e se realizará na coletividade. Então, se isto ocorrer, o cidadão desfrutará de momentos de felicidade. / This research aims to study the concept of state in Hegel and to show how this institution is essential for the individual and whole community to gain freedom. Throught this investigation, logic and dialectic criteria are used, which are peculiar to this philosopher. In studies about Hegel.s philosophy of law, the principle of freedom is the foundational concept and it pervades the logical-dialectical moments of the philosophy of law, from the abstract right to its ultimate fulfillment in the ethics and, more specifically, in the State. The state, in turn, enables the completion of the individual, without, however, destroying the family and bourgeois society, because they form the basis of the State. The organization and citizen involvement with the state is so deep that he feels responsible for ensuring not only his freedom but also that of each member, through the promulgation of the Constitution arising from the habits and customs of a people. In this case, only when the state is in its logical-dialectical moment, the citizens feel fully free and fulfilled in the society. So if this happens, the citizen enjoys moments of happiness.
