Previous issue date: 2014-08-25 / The theme Constitutional Law in economic relations: the analysis of the ILO Convention 87 and its effects on trade unionism and freedom of association in Brazil, examined in this dissertation, has as a starting point the analysis of the current context of the trade union movement in Brazil, emphasizing the study of compatibility of the principle of freedom of association and the Brazilian legal order. The relevance of this study is justified by the need of an analysis of the complex situation of national trade union movement, discussing the change of the current scenario, which will only be possible with free and strong trade unions based on the principle of freedom of association. The main methodology of this study is based the bibliographical, historical, jurisprudential and documentary research. The study is constituted by four chapters. Initially, this research analyzes the historical evolution of the trade union movement, the workers achievement and the relationship between the trade unionism and the Brazilian Constitutions, through the different phases of the Brazilian trade unionism. The
second Chapter studies the freedom of association, one on the fundamental principles at work and the approval by the ILO of the Convention 87, the paradigm of freedom of association. The Chapter also analyzes the relationship between the Convention 87 and the Brazilian Constitution. The third Chapter examines the ILO, its structure and organs, emphasizing the Committee of Freedom of Association (CFA) that was created to review the complaints presented against member States, even in the case of non-ratified Conventions. The Chapter describes and analyzes the main recommendations of the CFA to the Brazilian government and examines the only case of a complaint involving the issue of trade union unicity, n. 2099, presented by the Confederation of Workers in the Financing Institutions (CWFI). The last Chapter analyses the trade union movement and the effects of the globalization, technological developments, and the consequent changes in labour relations protagonists of the crisis that affects trade unions. In identifying trade union unicity as an element that aggravates the problem of trade union representation, this dissertation proposes the alteration of Article 8, Section II, of the Brazilian Constitution, aiming to ensure the effectiveness of the provisions
of Convention 87 in the national sphere.

seus reflexos no sindicalismo e na liberdade sindical no Brasil, estudado na presente
dissertação, tem como ponto de partida o contexto atual do movimento sindical no Brasil,
com ênfase na análise entre o princípio da liberdade sindical, proclamada pela Convenção 87 da OIT, e o ordenamento brasileiro. A relevância do trabalho se justifica pela necessidade da análise da complexa situação do movimento sindical pátrio, com a discussão sobre a mudança no cenário atual, o qual somente será possível com sindicatos fortes e livres baseados no princípio da liberdade sindical. A principal metodologia utilizada na elaboração da dissertação tem como base um estudo desenvolvido por meio de pesquisa bibliográfica, histórica, jurisprudencial e documental. A pesquisa, composta de quatro capítulos, inicialmente, faz uma análise da evolução histórica do movimento sindical, as conquistas dos trabalhadores e a relação do sindicalismo com as Constituições do Brasil, em que se constatam as várias fases em que passou o sindicalismo brasileiro. O segundo Capítulo trata-se da liberdade sindical, um dos princípios fundamentais para o trabalho, e a aprovação pela Organização Internacional
do Trabalho (OIT) da Convenção 87, paradigma da liberdade sindical. O Capítulo analisa
ainda a relação da Convenção 87 com a Constituição de 1988. Em seguida, examina-se a OIT, sua estrutura e órgãos, com destaque para o Comitê de Liberdade Sindical (CLS), criado com a finalidade de analisar as queixas sobre violação de liberdade sindical contra Estados membros, inclusive, no caso de convenções não ratificadas. O Capítulo descreve e analisa as principais recomendações do CLS ao governo brasileiro e examina o único caso, número 2099, impetrado pela Confederação Nacional dos Trabalhadores em Instituições Financeiras (CNTIF), que trata sobre queixa de violação da liberdade sindical pelo Brasil relacionada à unicidade sindical. Por último, analisa-se o movimento sindical sob os efeitos da globalização, do avanço das tecnologias e as consequentes modificações ocorridas na relação laboral, protagonistas da crise pela qual passam os sindicatos. Ao identificar que a unicidade sindical agrava o problema da representação, a dissertação propõe a alteração do artigo 8º, II da Constituição brasileira com o escopo de garantir a efetivação dos preceitos da Convenção 87 no âmbito nacional.
