Previous issue date: 2014-01-31 / Various human activities contribute to the scarcity of natural resources. The main one is the industrial activity and its products. In this context , it is noteworthy the construction , responsible for the high demand of non-renewable resources at the beginning of the production chain, the processes which depend on high energy consumption and high waste generation. To reconcile the potentially polluting activities to sustainable development , the National Environmental Policy Act created the environmental licensing as a tool to be used in order to minimize negative environmental impacts. Considering that Brazil was the country characterized by bureaucratic processes, the aim of this paper is to analyze the legal protection of the environment in the context of sustainable development, with emphasis on the role of the environmental license for the construction of condominiums and subdivisions in the city of Mossley and how effective the instrument responsible for environmental preservation. To consolidate research carried out a descriptive analysis of the responses obtained from the semi-structured questionnaires answered by the Director of Environmental Control of the Secretariat of the Environmental Management System (EMS ) in the city of Natal, three officials said Undersecretary responsible for overseeing projects that are in licensing and the managers of the selected contractors process. At the end of the survey it was found that the SGA has a body of compromised servers to protecting the environment and performs a well- coordinated work to achieve sustainable development in construction. It was also an absence of servers to carry out the inspection activities of the environmental licensing. Regarding companies that operate in the construction business, they were emphatic in stating the importance of environmental permits for the preservation of the environment, but that does not justify performing the procedure without clamor arising from excess requested documents , increasing the cost of work and delaying the granting of licenses. Given what was searched, it was found that environmental licenses in construction reduce negative environmental impacts. However, it could be more effective if there were a greater number of tax in Town of Mossoró / Diversas atividades humanas contribuem para a escassez dos recursos naturais. A principal delas é a atividade industrial e seus produtos. Neste contexto, destaca-se a construção civil, responsável pela alta demanda de recursos não renováveis no início de sua cadeia produtiva, pelos processos que dependem de alto consumo energético e pela elevada geração de resíduos. Para compatibilizar as atividades potencialmente poluidoras com o desenvolvimento sustentável, a Política Nacional do Meio Ambiente criou o licenciamento ambiental como instrumento a ser utilizado com o fim de minimizar os impactos ambientais negativos. Tendo em vista ser o Brasil o país caracterizado por processos burocráticos, o objetivo desse trabalho é analisar a proteção jurídica do meio ambiente no contexto do desenvolvimento sustentável, com ênfase ao papel do licenciamento ambiental, para a construção dos condomínios e loteamentos no município de Mossoró e como instrumento responsável por efetivar a preservação ambiental. Para consolidar a pesquisa fora realizada uma análise descritiva, a partir das respostas obtidas pelos questionários semiestruturados respondidos pelo Diretor de Controle Ambiental da Subsecretaria da Gestão Ambiental (SGA) do município de Mossoró, por três funcionários da referida Subsecretaria responsáveis pela fiscalização dos empreendimentos que estão em processo de licenciamento e pelos gestores das empreiteiras selecionadas. Ao final da pesquisa constatou-se que a SGA possui um corpo de servidores comprometidos com a proteção do meio ambiente e realiza um trabalho bem articulado para atingir o desenvolvimento sustentável na construção civil. Detectou-se, ainda, a ausência de servidores para efetivar a atividade fiscalizatória do licenciamento ambiental. No tocante às empresas que atuam no ramo da construção civil, elas foram enfáticas ao afirmarem sobre a importância das licenças ambientais para a preservação do meio ambiente, mas justificaram que não realizam o processo sem clamores decorrentes do excesso de documentos solicitados, aumentando o custo da obra e atrasando a concessão das licenças. Diante do que foi pesquisado, verificou-se que as licenças ambientais na construção civil reduzem os impactos ambientais negativos. Contudo, poderia ser mais efetivo se houvesse um número maior de fiscais na Prefeitura Municipal de Mossoró
