nãmbro de 2016, como forma mais eficaz para que os entes federativos possam cumprir com os objetivos da política urbana, no sentido de garantir o desenvolvimento das funções sociais da propriedade urbana por meio da política de Regularização Fundiária proposta pelo governo em exercício. O trabalho teve o escopo precípuo de desmistificar a concepção negativa de que a Regularização Fundiária não se coaduna com os objetivos fundamentais estabelecidos constitucionalmente, e vai ao encontro do que se propunha na Lei n.º 11.977/2009. Na verdade, por muito esforço de urbanistas e ambientalistas, a nova Lei trouxe institutos simplificados e manteve outros importantes formalmente estabelecidos na Lei n.º 11.977, de 2009. Para tanto, o trabalho partiu da evolução do conceito de regularização fundiária urbana, tendo como referência o direito à moradia, a Lei de Parcelamento do Solo - Lei n.º 6.766/1979; o Estatuto da Cidade - Lei n.º 10.257/2001; outros diplomas sobre o tema e a recente Lei n.º 13.465/2017, que revogou os artigos da Lei - ¿Minha Casa, Minha Vida¿ - sem deixar institutos fundamentais, como a manutenção da demarcação urbanística e da ZEIS, que tinham sido excluídas da Medida Provisória n.º 459, de 2016, que deu origem à norma apreciada nesta monografia. O método empregado foi o hipotético-dedutivo; o material, a pesquisa documental, em que se consideraram documentos e outros elementos para se buscar o aprofundamento em áreas cruciais, tal como a que viabiliza a regularização de ocupações em áreas que até então se encontravam longe dessa providência. / This paper examined the institute of urban land regularization in the new Law n. 13.465/2017 as an alternative to cooperate with the Public Administration to comply with urban policy objectives to guarantee the development of the social functions of urban property. This monography analyzed the challenges for the land regularization in Brazil, also having irregular areas in mind. With the goal of demystifying the negative conception that the regularization is a negative perspective that has gained over the years, as well as demonstrating the challenges of changed of the new Law. This paper begins with the evolution of the concept of urban land regularization, with reference to the right to housing, the Soil Installment Law - Law n. 6.766/1979; Law n. 10.257/2001 and the recent Law n. 13.465/2017, which repealed many articles from the Law n. 11.977, of 2009 without neglecting to consider the other legal grounds that justify its application. The method used was the deductive and hypothetic; the material, the documentary research, in which documents and other elements were considered to demonstrate the regularization of urban property in crucial areas, such as the one that makes possible the regularization of occupations in areas that until then were far from this providence.
