SANTRAUKA Nuosavybė yra laikoma visuomenės pagrindu. Nuosavybės teisė atsiranda teisės normų pagrindu. Nuosavybės teisės įgijimo į nekilnojamuosius daiktus momentas pagal senąjį ir dabartinį Lietuvos Respublikos civilinį kodeksą yra nustatomas skirtingai. Šiame darbe kalbama apie nuosavybės teisės įgijimą į nekilnojamuosius daiktus įvairiais Lietuvos Respublikos civiliniame kodekse numatytais pagrindais: pagal pirkimo-pardavimo, dovanojimo, mainų sutartis; paveldėjimo būdu; įgyjamąja senatimi; pagaminant naują nekilnojamąjį daiktą; paimant nekilnojamąjį daiktą visuomenės poreikiams. Be to, darbe bus atskleidžiama nuosavybės teisė į nekilnojamuosius daiktus įgijimo momento nustatymo reikšmė, kadangi nuo šio momento atsiranda tiek savininko teisės tiek ir pareigos: suteikiama galimybę įgyvendinti nuosavybės teisę, atsiranda savininko teisių apsauga, savininkui suteikiama teisė ginti savo nuosavybės teisę įstatymų nustatytais būdais, atsiranda savininko atsakomybė bei pareiga mokėti įstatymų nustatytus mokesčius. / SUMMARY “The moment of acquiring ownership title into intangible assets and the importance of its determination” This paper analyses relevant issue – the moment of acquiring ownership title into intangible assets and the importance of its determination. It is very important to find it out exactly, because when a person becomes an owner of an intangible assets, hi gets the rights and the obligations of the owner. Comparing with previous Civil code, situation nowadays has changed. The real estate is an object of huge amount of transactions, that is why the goal is to make clear the moment of acquiring ownership on the different basis. It also tries to show what kind of practical problems could arise, and what the main purpose of registering the real estate after becoming an owner is. In this paper attention is also paid to the very important issue – to the importance of determination of moment of acquiring ownership, to understand what kind of rights and obligations a person has, since acquiring ownership. It also pays attention to what is different and similar concerning the moment of acquiring ownership title into intangible assets and the importance of its determination not only in Lithuanian, but in other countries also.
