In order to provoke a coherent linguistic debate it is used as the theoretical base the New Rhetoric especially as described in the studies of Chaim Perelman & Luci Olbrechts-Tyteca Michel Meyer and Olivier Reboul focusing argumentative aspects of the law discourse
It also uses the studies of Michel Foucault emphasizing the power relation created in/by social and interpersonal relations which emerge from the discourse / Este trabalho promove uma discussão acerca da produção de verdade no discurso jurídico a partir de uma perspectiva discursiva tendo como corpus de análise um assassinato ocorrido na cidade de São Paulo no qual o marido é o maior suspeito da morte da esposa
A fim de oferecer uma discussão lingüística coerente usa a Nova Retórica como base teórica especialmente como descrita nos estudos de Chaim Perelman & Lucie Olbrechts-Tyteca Michel Meyer e Olivier Reboul com enfoque nos aspectos argumentativos do discurso jurídico
Também são usados os estudos de Michel Foucault enfatizando as relações de poder criadas nas/pelas relações interpessoais e sociais que emergem do discurso
