Elle s'intéresse en particulier à démontrer la domination du dualisme qui la caractérise et qui imprègne la pratique juridique internationale sur celles-ci, et à en offrir une analyse critique. Car le dualisme dans la théorisation des organisations internationales en droit n'est pas anodin. Au contraire, il est à la source d'ambiguïtés au cœur des régimes juridiques proposés, tout comme il révèle des enjeux tant conceptuels que structurels. D'où l'intérêt d'y porter une attention particulière. Jetant un regard novateur sur le dualisme dans la théorisation des organisations internationales en droit, cette thèse révèle la nature paradoxale d'une approche dualiste. Car si le dualisme répond à une nécessité conceptuelle et structurelle, il s'inscrit et participe également à l'attachement plus profond du juriste (internationaliste) à des réflexes structuralistes. Des réflexes qui se traduisent en droit et dans la pensée juridique par l'attrait qu'exerce l'idée de « structure » - dualiste, logique et cohérente - ainsi que les structures de pensées disciplinaires dualistes. Des catégories, modèles, ou plus simplement un « code », binaire, qui s'avèrent être à la base de la définition du statut et du rôle des organisations internationales en droit, tout en étant à la source des plus grands paradoxes actuels dans le cadre des défis auxquels doit fait face le concept d'organisation internationale. / This thesis offers a cross-cutting and analytical study of the theorization of international organizations in international law. It examines the dualism that dominates the theorization of international organizations and reflects on the international practice pertaining to international organizations and proposes a critical analysis. This critical appraisal reveals itself as crucial as dualism in the theorization of international organizations is never a neutral approach. On the contrary, dualism is the source of numerous ambiguities in the legal framework and has implications on the concept and the overall structure - or pattern - of thought. Offering a fresh perspective on dualism in the theorization of international organizations in international law, this thesis unveils the paradoxical nature of a dualistic approach. Since dualism responds to a certain conceptual and structural necessity, it also participates to the commitment of the (international) jurist to structuralist moves. By virtue of such moves, a certain idea of "structure" - dualistic, logical, and coherent - as well as dualistic disciplinary mental structures have come to permeate international legal thought. These dualistic categories, models, or simply a "code" are at the core of the definition of the status and the role of international organizations in international law. However, as such, they are also at the heart of the major challenges that the concept of international organization faces today.
