El presente informe analiza la Resolución Nº 3703 -2022-SUNARP-TR; en la cual
se establece que es posible inscribir cualquier tipo de cláusula que limite las
facultades de uso y disfrute, pero aquella que limite la disposición no podrá
inscribirse jamás. Ello se desprende de la prohibición a este tipo de cláusulas
que se encuentra establecido en el Código Civil peruano.
Luego, se utilizara este caso precisamente para exponer los elementos más
esenciales entorno a la limitación de la facultad de disposición de la propiedad.
Así como para criticar tanto la calidad de la motivación del Tribunal Registral en
este tipo de casos y finalmente incluso la idoneidad de la norma prohibitiva del
Código Civil. / The present report analyzes the Resolution Nº 3703 -2022-SUNARP-TR, in
which it is established that is possible to register any kind of clause that limits the
faculties of use and enjoyment, but the clause that limits disposition could never
be register. This comes from the prohibition of this kind of clauses as established
in the Peruvian Civil Code.
Then, we will use this case precisely to expose the more essential elements
around the limitation of the faculty of disposition of property. And also to criticize
the quality of the reasoning of the registry court in this kind of cases and finally
even the suitability of the prohibitive rule in the Civil Code.
