En el presente informe, se realiza un análisis respecto a la iniciativa probatoria del juez; es decir, la prueba de oficio. Dicho estudio, se efectúa a la luz de la Casación N° 1242-2017-Lima Este, emitida por la Sala Civil de la Corte Suprema de Justicia de la República del Perú, la cual dio origen al X Pleno Casatorio Civil. En ese sentido, se determinará si lo desarrollado en ciertas reglas vinculantes del X Pleno Casatorio Civil es una interpretación acorde a derecho, manteniendo como límite lo establecido en el artículo 194° del Código Civil, así como respecto a otros artículos y principios del proceso civil / In this report, an analysis is conducted regarding the judge's evidentiary initiative: the ex officio evidence. This study is carried out in light of Cassation N° 1242-2017-Lima Este, issued by the Civil Court of the Supreme Court of Justice of the Republic of Peru, which gave rise to the Xth Civil Precedent.
