Previous issue date: 2014-01-30 / The present paper had been produced in concentration area of Penal System and Violence, at Research Line on Contemporaneous Juridical Penal Systems, throughout analysis of legislation, doctrine and Jurisprudence about the admissibility requisite of General Repercussion as known, preliminary at extraordinary appeals on criminal matter ambit premise which was included into juridical ordinance herein have been starting from number 45 Constitutional Amendment, of 2004, December 30th. During research, it did search for investigate all over adequacy of such a requirement from Law and Penal Process, detaining special attention on those terms contained at text of 543-A and 543-B articles from Civil Process Code, than ruptures with an appellate-equalized paradigm between Penal and Civil processes in face of the inherent warranties for a democratic Penal Process. Had whilst gone into considerations around damages to Penal Process inherent to fragility of adopted criteria at election of hypothesis which would have configure General Repercussion, including the form of judgment for Relevance Allegement that occurs through institution of a Virtual Tribunal, created and developed in the year of 2007− with objective of concentrating discussions about having existence or not regarding to General Repercussion on Constitutional questions sustained through Extraordinary Appeals, wherein the result of judgment is thrown in an automatic and electronic mode. It had pondered, finally, that Penal Law as well as Penal Process, do count with proper principles and guarantees from a system which must be rescued from way to guarantee the presuppositions of a Penal Process materially Democratic. At dissertation development, incursions happened emphasizing superiority of values notion, finalities, principles of Penal Process Law, specially, enrolled them at Federal Constitution, without disregarding on necessity of a critical attitude in relation to use of analogy on applied Civil Laws to Penal Process Law. Thus, it had aimed to discuss whether requirement of General Repercussion is in conformity to the demands from a Democratic State of Rights and a Penal Process oriented by guarantees foreseen at Constitutional text, mostly, those ones from Federal Constitution in its article 5th. / O presente trabalho foi produzido na ?rea de concentra??o Sistema Penal e Viol?ncia, na Linha de Pesquisa Sistemas Jur?dico-Penais Contempor?neos, a partir de an?lise das leis, da doutrina e da jurisprud?ncia sobre o requisito de admissibilidade da Repercuss?o Geral, preliminar no ?mbito dos recursos extraordin?rios em mat?ria criminal premissa que foi inclu?da no ordenamento jur?dico a partir da Emenda Constitucional n? 45, de 30 de dezembro de 2004. No decorrer da pesquisa buscou-se investigar a adequa??o desse requisito ao Direito, em especial, ao Processo Penal. Para tanto, dedicou-se especial aten??o aos termos contidos no texto do artigo 543-A e 543-B, do C?digo de Processo Civil, que rompem com um paradigma ison?mico-recursal entre processos penal e civil em face das garantias inerentes a um processo penal democr?tico. Adentrou-se, ainda, em considera??es sobre os preju?zos ao processo penal inerentes ? fragilidade dos crit?rios adotados na elei??o das hip?teses configuradoras de Repercuss?o Geral, inclusive da forma de julgamento que se d? atrav?s da institui??o do Tribunal Virtual, criado e desenvolvido no ano de 2007 com o objetivo de concentrar as discuss?es sobre a exist?ncia ou n?o de repercuss?o geral nas quest?es constitucionais suscitadas nos recursos extraordin?rios, onde o resultado do julgamento ? lan?ado de forma autom?tica e eletr?nica. Ponderou-se, finalmente, que tanto o Direito Penal como o Processo Penal conta com princ?pios e garantias pr?prios de um sistema que deve ser respeitado e resgatado de forma a garantir os pressupostos de um processo penal materialmente Democr?tico. No desenvolvimento da disserta??o, as incurs?es se deram com ?nfase na no??o de superioridade dos valores, dos fins e dos princ?pios do Direito Processual Penal, em especial, os inscritos na Constitui??o Federal, sem descurar da necessidade de uma atitude cr?tica em rela??o ao uso da analogia de leis civis aplicadas ao processo penal. Assim, buscou-se discutir se o requisito da Repercuss?o Geral est? em conformidade com as demandas de um Estado Democr?tico de Direito e com um processo penal orientado pelas garantias previstas no texto constitucional, em especial, no artigo 5? da Constitui??o Federal.
