Previous issue date: 2014 / O presente trabalho aborda o regime jurídico de patentes, de forma comparada entre os Estados Unidos da América e o Brasil, como instrumento estratégico de proteção dos alimentos para aves, bem como de estímulo a competitividade do setor. Neste ramo da indústria os dois países estudados são os dois dos maiores destaques, tanto como produtores de alimentos para aves como exportadores de tais alimentos. Diante de um crescimento constante da necessidade da humanidade de se alimentar e, consequentemente, do aumento no consumo de proteína animal por humanos, aumentou também o grau de investimentos e regulamentação sobre o setor. Resulta desta problemática o objeto central deste trabalho, que é a averiguação da existência de um efetivo sistema de patentes capaz de proteger os alimentos para aves, e processos envolvidos. A metodologia utilizada foi a da pesquisa bibliográfica e documental, aplicando-se o método comparativo. Dentro desta metodologia foram realizados levantamento de dados, doutrinas, leis, regulamentos, tanto dos EUA como do Brasil. Ao final, os dados levantados foram comparados, estabelecendo-se paralelos entre os regimes administrativos e jurídicos dos dois países. Por fim, entende-se que os objetivos desta pesquisa foram alcançados, demonstrando a importância dos alimentos para aves, desde o ponto de vista socioeconômico até o ponto de vista jurídico.<br> / Abstract: This paper discusses the legal regime of patents as a strategic instrument for the protection of animal feed for poultry as well as to stimulate the sector's competitiveness and compares it between the United States and Brazil. This branch of industry where the two countries studied are two of the biggest highlights, both as producers of animal feed for poultry and as exporters animal feed. Faced with a steadily growing need of humanity to feed and hence the increase in the consumption of animal protein by humans, also increasing the degree of investments and regulations regarding animal feed. As a result of this problem the central object of this work is to investigate the existence of an effective patent system capable of protecting the animal feed for poultry and it's processes of production. The methodology used was literature research and documentary research, applying the inductive and deductive methods. Within this methodology data, doctrine, law and regulations collections were conducted; both in the USA and Brazil. Finally, the collected data were compared, establishing parallels between the administrative and legal systems of both countries. As a result of the whole research it is possible to say that the objectives were achieved, demonstrating the importance of animal feed for poultry, from the socioeconomic and legal points of view.
