Previous issue date: 2011-06-17 / The difficulties in adopting a culture of intellectual property within the academic and
technology sectors limit the development of the country. The low initiative in actively
using the available legal resources to transform knowledge in to investment, with a
view to achieving common gains, constitutes an important issue. One of the solutions
to overcome such difficulties is to establish a culture of intellectual property. The
combination of objectives and efforts to establish such a culture is a relevant
strategy, in view of the great complexity involved in product and process innovation;
in the context of concentration of productive assets, in the new information era, and
in the internationalization of economies. A local culture of intellectual property allows
for a profound change in the pattern of the relationship between the State and
society, increasing participation, negotiation and democratization. The aim of this
study was to evaluate whether the development policies and the related legislation
achieve their objectives, among which the technological development rooted in the
registration of biotechnology patents. To that end, a study was carried out on the
perception of students and professors from the Graduate Program in Biotechnology
of the Federal University of Pelotas, seeking to identify the level of knowledge of
biotechnology researchers regarding the protection of intellectual property. This study
revealed that researchers are receptive to intellectual property and that providing
more information on the topic may contribute to new and efficient strategies to
develop research capacity and the university. The results of this study can be of great
value to guide actions towards a culture of biotechnology intellectual property within
the university. / As dificuldades na adoção de uma cultura de propriedade intelectual nos
setores acadêmico e tecnológico limitam o desenvolvimento do país. A pouca
iniciativa em utilizar ativamente os recursos legais disponíveis para transformar
conhecimento em investimento, com o objetivo de conquistar ganhos comuns,
apresenta-se como um fator preocupante. Uma das soluções para superar essas
dificuldades é o estabelecimento de uma cultura de propriedade intelectual. A
combinação de objetivos e esforços para o estabelecimento desta cultura afirma-se
como uma estratégia relevante em função da grande complexidade da inovação dos
produtos e processos; do quadro de concentração de ativos produtivos; da nova era
da informação; e da internacionalização das economias. A cultura da propriedade
intelectual, no âmbito local, oportuniza uma profunda transformação no padrão de
relação entre Estado e sociedade, no sentido de uma maior participação,
negociação e democratização. Esta dissertação teve o objetivo de avaliar se as
políticas públicas de desenvolvimento e a legislação pertinente atingem os objetivos
propostos, entre eles o desenvolvimento tecnológico alicerçado no registro de
patentes em biotecnologia. Para isso, foi feito um estudo da percepção dos
estudantes e professores do Programa de Pós-Graduação em Biotecnologia e
alunos de iniciação científica da graduação em Biotecnologia da Universidade
Federal de Pelotas, procurando identificar o nível de conhecimento das pessoas que
trabalham com pesquisa em Biotecnologia, no que diz respeito à proteção da
propriedade intelectual. O presente estudo revela que há receptividade acadêmica
ao tema e que um acréscimo de informações relativas ao tema propriedade
intelectual pode contribuir em novas e eficientes estratégias de desenvolvimento da
pesquisa e da universidade. Os resultados obtidos neste estudo poderão ser de valia
para utilização como norteadores de ações em busca da cultura da propriedade
intelectual em biotecnologia dentro da universidade.
