Trata-se de dissertação propositiva a qual tem como objetivo sugerir a implantação
de um Núcleo de Reflexão e Ressocialização para Autores de Violência Doméstica
como Ponte para Efetividade de Proteção à Mulher. Para tanto, fez-se um estudo
sobre contexto histórico de fatores sociais e culturais que tem contribuído no
processo educativo do homem, as lutas e conquistas das mulheres do período
colonial aos dias atuais em prol de seus direitos, como de liberdade de expressão e
dignidade humana, culminando em uma das principais conquistas no combate à
Violência Doméstica – a criação da Lei Maria da Penha – que trouxe, além de
medidas protetivas de urgência em desfavor do agressor, outras medidas que se
findaram numa Rede de Atendimento à Mulher e, consequentemente, ao homem.
Este estudo se justifica em razão de sua importância para o Tribunal de Justiça do
Estado do Tocantins; para o autor desta pesquisa enquanto profissional atuante na
área jurídica; e para a sociedade, uma vez que o alto índice de violência contra a
mulher presente no estado do Tocantins, indicado pelas estatísticas, aponta o
Estado, em âmbito nacional, em segundo lugar no ranking, e a capital Palmas em
primeiro lugar no tema violência doméstica. Para o trabalho, foi utilizado o método
positivista por mais se adequar à proposta, procurando verificar a realidade dos fatos
e dados extraídos de pesquisas realizadas por órgãos da Justiça, bem como a
pesquisa empírica. Os resultados indicam que em regiões no Brasil onde foram
implantados Núcleos de Reflexão e Ressocialização houve resultados positivos, com
índice de reincidência chegando a zero, confirmando que para uma verdadeira
mudança de pensamento, transformação, o homem precisa passar por um processo
de reeducação, que, para o presente caso, virá a partir de encontros nos Núcleos
que seguem como sugestão para a solução de conflitos domésticos no Estado. / This is a propositional dissertation which purpose is to suggest the implantation of a
Reflection and Resocialization Nucleus to authors of domestic violence as a bridge
for effectiveness on women protection. In order to do so, a study was made and it
was about the historical context of social and cultural factors that contributed to the
educational process of men, the strive and achievements of women for their rights
from the colonial period to the current days, such as freedom of expression and
human dignity, culminating in one of the main achievements in the fight against
domestic violence – the creation of the Maria da Penha Law – which brought, in
addition to emergency protective measures in the disfavor of the agressor, other
measures that turned out to be an Assistance Network for women, and consequently,
for men. This study is justified because of its importance to the State of Tocantins
Court of Justice and to the author of this research as a legal professional, and to
society, once the high rate of violence against women in the State of Tocantins,
indicated by statistics, points the State Nationwide as second in the ranking, and the
Capital Palmas as first in the theme domestic violence. For the project, a positivist
method was used for being more suitable to the proposal, seeking to verify the reality
of the facts and data extracted from researches carried out by Justice agencies, as
well as the empirical research. The results indicate that the regions in Brazil in which
Reflection and Resocialization Nucleus were implanted, there were positive results,
with a recurrence rate reaching zero, confirming that for a true change of thinking,
transformation, men must undergo a re-education process, that, for the present case,
will come from meetings in the Nucleus that follow as a suggestion for the domestic
conflicts solution in the State.
