Previous issue date: 2015-09-11 / The thesis presented here, entitled The extension of the exercise of freedom of
expression through social networks of the Internet and the reformulation of the
constituent elementary concepts of the State, is part of the essential requirements for
obtaining a doctoral degree from the graduate program constitutional law at the
University of Fortaleza, in the Public constitutional Law and in the area of Democracy
Theory research line. The discussion on the topic object of this thesis is part of the very human context, since even though freedom of expression and valuable to society, she
experienced fluctuations in their recognition and protection under, having suffered over
the centuries blows of the most various kinds. For this research ranged from classical
authors on the same matter freedom to contemporary authors, who in addition to
studying the topic freedom also specifically investigated the right to freedom of
expression in Brazil and in several other countries. In addition to doctrinal research is presented in this thesis a judicial research collected in international courts and tribunals on cases involving conflicts between freedom of expression and other fundamental rights, as well as a thorough analysis of the case of the massacre at the headquarters of the French newspaper Charlie Hebdo. In this context, it was shown that social networks are expanding tools of freedom of expression and that it led to the maximization of the collision between routes this fundamental right and others of the same nature and on the other hand, they gave rise to the need for a new conceptualization of the constituent elements of the State, namely, people, territory and sovereign power, considering that the classical concepts of these elements are not in line with the new objective reality brought about by the use of the internet and its social networks. Thus, it has been problematic as defining how the state should behave on the expansion of the aforementioned collision routes, especially those that are formed between the fundamental right to freedom of expression and other fundamental rights, such as honor, the image, religious freedom and privacy. Thus the objective of this research is to contribute to the realization of the fundamental right to freedom of expression in Brazil, especially regarding the fight against censorship and prohibitions to freedom of expression of thought and information through social networks the internet. The specific objective is to discuss the ways in which the state should act, taking into account the new concepts presented here of its constituent elements, to prevent and resolve collision routes between the fundamental rights before his maximize the use of social networks the Internet. Was elected to both the inductive method, using bibliographic research. Have been as expected results: a) prove that social networks of the Internet are tools that maximized the conceptual framework and the exercise of the fundamental right to freedom of expression, which, because of this maximization , provided the increase in tension between various fundamental rights which, with him, may enter on a collision course; b ) discuss how the state should act to prevent and resolve the object collision routes this thesis; c ) provide another insight into the concepts of people , territory and sovereignty, which must be reformulated in the face of objective reality brought by the social networks of the Internet. Collision routes. / A tese que ora se apresenta, intitulada A ampliação do exercício da liberdade de
expressão pelas redes sociais na internet e a reformulação dos conceitos elementares
constitutivos do Estado, faz parte dos requisitos essenciais para a obtenção do grau de
doutoramento do programa de pós-graduação em direito constitucional da Universidade
de Fortaleza, na área de Direito Constitucional Público e na linha de pesquisa Teoria da
Democracia. A discussão sobre o tema objeto desta tese faz parte do próprio contexto
humano, uma vez que, mesmo sendo a liberdade de expressão valioso bem para a
sociedade, ela experimentou oscilações em seu reconhecimento e âmbito de proteção,
tendo sofrido, ao longo dos séculos, golpes das mais diversas naturezas. Para tanto, a
pesquisa abrangeu desde autores clássicos que tratam do tema liberdade até autores
contemporâneos, os quais, além de estudarem o tema liberdade, também investigaram,
especificamente, o direito à liberdade de expressão no Brasil e em vários outros países.
Além da pesquisa doutrinária, apresenta-se, nesta tese, uma pesquisa jurisprudencial
coletada nas cortes e tribunais internacionais sobre processos envolvendo conflitos
entre a liberdade de expressão e outros direitos fundamentais. Analisa-se também o
caso do massacre na sede do jornal francês Charlie Hebdo. Nesse contexto,
comprovou-se que as redes sociais constituem instrumentos de expansão da liberdade
de expressão e que, com isso, ocasionam a maximização das rotas de colisão entre
esse direito fundamental e outros da mesma natureza. Por outro lado, fizeram surgir a
necessidade de se analisar os conceitos dos elementos constitutivos do Estado, a
saber, povo, território e poder soberano, tendo em vista que os conceitos clássicos
desses elementos não se coadunam com a realidade fática trazida pela utilização da
internet e de suas redes sociais. Assim, tem-se, como problematização, a definição de
como o Estado deve se portar diante da ampliação das rotas de colisão acima
mencionadas, em especial as que são formadas entre o direito fundamental à liberdade
de expressão e outros direitos fundamentais, tais como, a honra, a imagem, a liberdade
religiosa e a privacidade. Desse modo, o objetivo geral desta pesquisa é contribuir para
a efetivação do direito fundamental à liberdade de expressão no Brasil, especialmente
no que concerne ao combate à censura e a vedações à liberdade de manifestação de
pensamento e de informação pelas redes sociais na internet. O objetivo específico é
discutir as formas como o Estado deve atuar, levando em conta a conceituação aqui
apresentada dos seus elementos constitutivos, para previnir e solucionar as rotas de
colisão entre os direitos fundamentais, diante da sua maximização pelo uso das redes
sociais na internet. Elegeu-se, para tanto, o método indutivo, utilizando-se de pesquisa
bibliográfica. Têm-se como resultados esperados: a) comprovar que as redes sociais na
internet são instrumentos que maximizaram o âmbito conceitual e o exercício do direito
fundamental à liberdade de expressão, o qual, devido a essa maximização,
proporcionou o incremento da tensão entre vários direitos fundamentais que, com ele,
podem entrar em rota de colisão; b) discutir a maneira como o Estado deve atuar para
prevenir e solucionar as rotas de colisão objeto desta tese; c) apresentar outra visão
sobre os conceitos de povo, território e soberania, os quais devem ser reformulados, em
