Previous issue date: 2017 / O tema de que trata a presente dissertação alude à necessidade de utilização do instituto denominado repercussão geral das questões constitucionais no âmbito do Supremo Tribunal Federal. O seu objetivo é verificar as funções desempenhadas por esse Tribunal e o cenário de crise em que se insere ao longo dos anos de sua instituição, destacando a imprescindibilidade de utilização do filtro recursal da repercussão geral para preservação do seu papel de intérprete da Constituição Federal e contenção da crise. Para atingir esse propósito, o trabalho utiliza, como apoio metodológico, a abordagem dedutiva e a técnica de pesquisa bibliográfica. O referencial teórico, considerado essencial para dar conta do tema escolhido e da respectiva questão-problema, foi reunido em três capítulos. O primeiro apresenta dois grandes modelos de Tribunais Superiores ? a Corte de Cassação francesa e a Suprema Corte norte-americana ?, as funções exercidas por esses órgãos judiciais e as influências sobre o Supremo Tribunal Federal. O segundo capítulo se dedica ao histórico do Supremo Tribunal Federal, desde sua instituição, consolidação da crise e formas de contenção da problemática. O terceiro e último capítulo trata, especificamente, da repercussão geral, da sua definição, seu procedimento e sua aplicação no sistema jurídico. Com esteio no esforço de pesquisa realizado, pode-se afirmar que o acúmulo de processos que tratam de questões sem relevância, no Supremo Tribunal Federal, é prejudicial ao exercício de sua função constitucional, o que muito contribui para a inviabilidade de uma prestação jurisdicional qualificada e estável. Para solucionar esse problema, a adequada utilização da repercussão geral é medida indispensável.<br> / Abstract : The theme covered by the present dissertation alludes to the necessity of utilizing the institute known as general repercussion of constitutional matters within the scope of the Supremo Tribunal Federal. Its objective is to verify the functions carried out by this Court and the crisis scenario in which it is inserted throughout the years of its institution, highlighting the indispensability of the utilization of the case selection mechanism of general repercussion for the preservation of its role and contention of the crisis. To achieve this goal, the present work utilizes as methodological support the deductive approach and the bibliographical research technique. The theoretical reference considered essential to deal with the chosen theme and the respective question-problem was consolidated into three chapters. The first one presents two major models of Supreme Courts ? the French Court of Cassation and the American Supreme Court ?, the functions carried out by these judicial bodies and their influences on the Supremo Tribunal Federal. The second chapter is dedicated to the history of the Supremo Tribunal Federal, since its institution, consolidation of the crisis and forms of containment of the problem. The third and final chapter deals, specifically, with the general repercussion, its definition, its procedure and its application in the judicial system. With support from the research effort deployed, it can be affirmed that the accumulation of cases that deal with matters of no relevance in the Supremo Tribunal Federal is harmful to the exercise of its constitutional function, which greatly contributes to the infeasibility of a qualified and stable jurisdiction. In order to solve this problem, the adequate employment of the general repercussion is an indispensable measure.
