Previous issue date: 2018-10-26 / This work is delimited in the area of concentration of Private Constitutional Law, and in the line of research in Constitutional Law in Private Relations. It is justified by the relevance and necessity of health as a constitutional asset and also the understanding that the company is not merely seeking profit but must also respond for its actions, in this way the company becomes a legal entity with rights and duties. In this way, we find clearly the essence of the company transformed by a new concept added to the criterion of corporate social responsibility. It is imperative to trace an analysis of the historical evolution of enterprises and the participation
of the state with its contribution and often the regression it has led in repressive acts.Uncontroversial is the contributory character of the company to the society leading to socioeconomic development. The research found a differentiation between social function and the social responsibility of the company with the application of compliance as instruments of administration and expansion of the company that will be presented in the dissertation that is being presented. The methodology used for the purposes of the objectives was explanatory and how much the sources had documentary and bibliographic criteria in order to be used research in the national and foreign laws, as well as the doctrines on the studied literature and the jurisprudence on the context. He analyzed one of the main pillars of the corporation which is the safety and health of the worker. We believe that without it, healthy and balanced business development becomes impossible. He investigated the subject in a quantitative and qualitative way, focusing on its mixed, theoretical and practical nature. He examined the accommodation of the matter in question, nowadays, in order to observe influences and possible legislative deficiencies. The dissertation dealt with compliance as an instrument of
application of Social Responsibility demonstrating the extrafiscal tax gains related to the good effectiveness of the norms and measures of safety and health of the worker for the good growth of the corporation and society in the socioeconomic aspect. This makes clear the importance of the company for the development of society as well as the relevance of the worker and the safeguard of his life and worker. Finally, he offered a synthetic analysis on theory and practice as a form of perception of the sensitive conceptualization of the juxtaposition of the application of social responsibility through the safety and health of the artificer.

Privado, e na linha de pesquisa em Direito Constitucional nas relações Privadas. Justifica-se pela relevância e necessidade da saúde como bem constitucional e também o entendimento que a empresa não é meramente buscadora de lucro mas deverá também responder por seus atos, desta forma a empresa torna se pessoa jurídica com direitos e deveres. Deste modo,encontramos de forma clara a essência da empresa transformada por um novo conceito somado ao critério da responsabilidade social corporativo. Imperioso traçar uma análise na evolução histórica das empresas e a participação do Estado com sua contribuição e muitas vezes o retrocesso por ele conduzido em atos repressivos. Incontroverso é o caráter contributivo da empresa para a sociedade guiando ao desenvolvimento sócio econômico. A pesquisa constatou uma diferenciação entre função social e a responsabilidade social da empresa com a aplicação da compliance como instrumentos de administração e expansão da empresa que serão apresentados no estudo dissertativo que está sendo apresentado. A metodologia utilizada quanto aos fins dos objetivos foi explicativa e quanto as fontes teve critério documental e bibliográfico de forma a ser usada pesquisa nas leis nacionais e do exterior, como também as doutrinas sobre a literatura estudada e as jurisprudências sobre o contexto. Analisou se um dos principias pilares da corporação que é a segurança e saúde do trabalhador. Entendemos que sem ela torna se impossível o saudável e equilibrado desenvolvimento empresarial. Investigou o tema de modo quantitativo e qualitativo, focando em sua natureza mista, teórica e prática. Examinou a acomodação da matéria em questão, sobremaneira, na atualidade, para assim, observar influencias e eventuais carências legislativas. A dissertação tratou a compliance como instrumento de aplicação da Responsabilidade social demonstrando os ganhos tributários extrafiscais referentes a boa efetividade das normas e medidas de segurança e saúde do trabalhador para o bom crescimento da corporação e da sociedade no aspecto sócio econômico. O que deixa claro sobre a importância da empresa para o desenvolvimento da sociedade bem como a relevância do trabalhador e o resguardo de sua vida e trabalhador. Por fim, oportunizou análise sintética sobre teoria e prática como forma de percepção da sensível conceituação da justaposição da aplicação da responsabilidade social através da compliance da segurança e saúde do artífice.
