La libre iniciativa privada, el derecho a la libertad de empresa y la libre competencia
están reguladas en la Constitución Política del Perú, por lo que el Estado es el
encargado para velar por el respeto y tutela de estos derechos. Sin embargo, el
ejercicio de estas libertades no es irrestricto, pues, a fin de proteger los intereses de
la sociedad, los agentes económicos deberán cumplir con disposiciones dictadas por
la administración tales como requisitos, exigencias, prohibiciones, cobros, etc.,
conocidas como barreras burocráticas. Estas pueden ser perjudicables cuando se
emiten sin considerar el marco legal vigente o cuando no es proporcional al interés
público a tutelar. Frente a ello, el INDECOPI es el encargo de verificar dichas
arbitrariedades a través de controles de legalidad y razonabilidad inaplicando, en
varias oportunidades, normas que afecten a los agentes económicos el acceso o la
permanencia en el mercado.
En el presente informe jurídico se analiza el Expediente N°080-2009/CEB,
procedimiento administrativo seguido por la empresa El Purgatorio S.A.C contra la
Municipalidad de Miraflores. El objetivo del informe jurídico es determinar si la
restricción de horarios de funcionamiento recaída en la Ordenanza N°263-MM
configura una barrera burocrática ilegal y/o carente de razonabilidad. A tal efecto, la
autora aborda temas tales como las atribuciones y competencias de las
Municipalidades y de la Comisión de Eliminación de Barreras burocráticas, la
revocación del acto administrativo y la metodología del análisis de legalidad y
razonabilidad (interés público, proporcionalidad y medida menos gravosa). Para el
desarrollo del informe se utiliza doctrinas nacionales e internacionales, así como
diversos pronunciamientos del Tribunal Constitucional y del INDECOPI, concluyendo,
que las restricciones de horarios de funcionamiento configuran una barrera
burocrática carente de razonabilidad. / Free private initiative, the right to freedom of enterprise and free competition are
regulated in the Political Constitution of Peru, for which the State is in charge of
ensuring respect and protection of these rights. However, the exercise of these
freedoms is not unrestricted, since, in order to protect the interests of society,
economic agents must comply with provisions issued by the administration such as
requirements, demands, prohibitions, charges, etc., known as bureaucratic barriers.
These can be harmful when they are issued without considering the current legal
framework or when it is not proportional to the public interest to protect. Faced with
this, INDECOPI is in charge of verifying said arbitrariness through the analysis of
legality and reasonableness, failing to apply, on several occasions, regulations that
affect economic agents' access or permanence in the market.
This legal report analyzes File No. 080-2009/CEB, an administrative procedure
followed by the company El Purgatorio S.A.C against the Municipality of Miraflores.
The objective of the legal report is to determine if the restriction of operating hours
relapsed in Ordinance No. 263-MM configures an illegal bureaucratic barrier and / or
care of reasonableness. To this end, the author addressed issues such as the powers
and competencies of the Municipalities and the Commission for the Elimination of
Bureaucratic Barriers, the revocation of the administrative act and the methodology of
the analysis of legality and reasonableness (public interest, proportionality and less
serious measure). For the development of the report, national and international
doctrines are used, as well as various pronouncements of the Constitutional Court and
INDECOPI, concluding that the restrictions on operating hours constitute a
bureaucratic barrier that is unreasonable.
