Previous issue date: 2009-11-05 / This one investigates, developed through a critical analysis of the public politics of decentralization implemented in Brazil, it looked, initially, to understand the implemented measures of incentive for the creation of the municipal systems of teaching considering the historical and political context. It looked, still, to understand like the Municipal System of Teaching of Santos's city it is responding to the education local demands and the declared objectives. So, we present initially an introduction pointing to the reasons that took the investigator to a present study, reasons very much made a list to the trajectory what it built in the public state net. Next, for better understanding of the education context, it was necessary to retake a revision of the literature that approaches the social politics in special of the education, to board the decentralization like political instrument and like part of the politics of education implemented when did not not be considered only as the form of administrative rationalization of the State, but like part of the political projects that give him meaning. When the studies were presented as to the local power as commitment in the process of democratization of the Brazilian state, and like stimulus to the organized participation of the society in the questions of public politics and decentralization of the power, the political education scenery presents himself regarding the municipal systems of teaching in the search of the apprehension of the local reality. After we carried out the analysis of the informations what we obtained through bibliographical fulfilled revision, of the official and legal documents, of the interviews it was noticed that the Municipal System of Santos's Teaching has been endeavoring in the sense of giving service to the education demands of the city, demonstrating the possibility to occupy a legitimate space in the society / Esta pesquisa, desenvolvida por meio de uma análise crítica da política pública de descentralização implementada no Brasil, buscou, inicialmente, compreender as medidas implementadas de incentivo para a criação dos sistemas municipais de ensino considerando o contexto histórico e político. Buscou, ainda, compreender como o Sistema Municipal de Ensino da cidade de Santos vem respondendo às demandas educacionais locais e os objetivos declarados. Assim, apresentamos inicialmente uma introdução apontando as razões que levaram a pesquisadora ao presente estudo, razões muito relacionadas à trajetória que construiu na rede pública estadual. Em seguida, para melhor compreensão do contexto educacional, foi necessário retomar uma revisão da literatura que trata das políticas sociais, em especial da educação, e abordar a descentralização como instrumento político e como parte das políticas de educação implementadas não considerada somente como uma forma de racionalização administrativa do Estado, mas como parte dos projetos políticos que lhe dão significado. Apresentados os estudos a respeito do poder local como engajamento no processo de democratização do Estado brasileiro, e como estímulo à participação organizada da sociedade nas questões de políticas públicas e descentralização do poder, apresenta-se o cenário político educacional em relação aos sistemas municipais de ensino na busca da apreensão da realidade local. Ao realizarmos a análise das informações que obtivemos por meio de revisão bibliográfica considerada, dos documentos oficiais e legais, das entrevistas constatou-se que o Sistema Municipal de Ensino de Santos tem envidado esforços no sentido de dar atendimento às demandas educacionais da cidade, demonstrando a possibilidade de ocupar um espaço legítimo na sociedade
