To accomplish it the study of the constitutional principles, of the social liability, and solidarity is necessary. The terminology of liability was also treated, suggesting the substitution of it to solidarity.
The focus was to find the identity of the social liability of the companies in the legal system, due to the fact that the qualification of the institutes is fundamental to its comprehension.
From this point, the possibility of regulation of the social liability has been analyzed. The benefits obtained by the social liability behavior and its abuse were also pointed / A responsabilidade social empresarial embora fundada na ética, mereceu nesse trabalho uma leitura sob o prisma do Direito.
Para tanto, mister se fez o estudo dos princípios constitucionais da função social e da solidariedade. A terminologia de responsabilidade também foi abarcada, sugerindo-se a sua substituição por solidariedade.
O objetivo foi encontrar identidade da responsabilidade social empresarial no ordenamento jurídico, haja vista que a qualificação dos institutos é fundamental para a sua compreensão.
A partir de então, fez-se a análise da possibilidade ou não da regulamentação do conteúdo da responsabilidade social. Apontou-se os benefícios obtidos pelo comportamento socialmente responsável e o seu abuso.
Tratou-se ainda das hipóteses de responsabilização civil por dano ocorrido nos projetos sociais
