A ideia de que as condições dignas de existência envolvem interesses não só
individuais, mas coletivos, ganhou espaço com a evolução dos direitos
metaindividuais e a consequente necessidade de criação de instrumentos hábeis a
proteção de direitos de grupos. Tal fenômeno abriu caminho para que a tutela
coletiva surgisse como instrumento protetor de necessidades primárias à vida digna.
Um ponto central que ficou evidenciado com respeito à coletivização de direitos é
sua inegável importância social. O presente estudo buscou analisar e demonstrar a
relevância desse fenômeno de coletivização dos direitos humanos, a partir da
identificação dos direitos de natureza coletiva: direitos difusos, coletivos strictu sensu
e individuais homogêneos. Além do estudo desses direitos, o trabalho enveredou
pela análise do processo coletivo para efetivação de direitos metaindividuais,
notadamente com foco na ação civil pública e a ação popular, instrumentos
escolhidos ante sua grande relevância na tutela dos interesses transindividuais. A
partir da análise dos direitos e interesses coletivos, bem como dos instrumentos de
tutela judicial desses interesses, afim de atender aos objetivos traçados para a
pesquisa realizou-se o diagnóstico das ações civis públicas e das ações populares
propostas na comarca de Gurupi durante os anos de 2013 a 2015. A análise
individual de cada ação propostas no período pesquisado foi realizada, sendo
colhidos os dados relativos ao número de ações em andamento, matérias discutidas
e grau de efetividade das demandas, dentre outros, sempre no sentido de se
construir um perfil de como essas ações vem sendo tratadas no judiciário
gurupiense. Ao final, o estudo permitiu uma análise crítica do perfil dessas ações,
possibilitando a efetiva consciência de como esse instrumento de jurisdição vem
sendo tratados na comarca pesquisada. / The idea that decent living conditions involve not only individual but collective
interests has gained space with the evolution of metaindividual rights and the
consequent need to create instruments that are capable of protecting the rights of
groups. This phenomenon paved the way for collective tutelage to emerge as a
protective instrument of primary needs for a dignified life. A central point that has
become evident with respect to the collectivization of rights is its undeniable social
importance. The present study sought to analyze and demonstrate the relevance of
this phenomenon of collectivization of human rights, based on the identification of
rights of collective nature: diffuse rights, collective strictu sensu and individual
homogeneous. In addition to the study of these rights, the work involved the analysis
of the collective process for the realization of metaindividual rights, especially
focusing on public civil action and popular action, instruments chosen in view of their
great importance in protecting transindividual interests. Based on the analysis of the
collective rights and interests, as well as the instruments of judicial protection of
these interests, in order to meet the objectives outlined for the research, a diagnosis
was made of public civil actions and popular actions proposed in Gurupi county over
the years From 2013 to 2015. The individual analysis of each action proposed in the
period surveyed was performed, and data were collected on the number of actions in
progress, topics discussed and degree of effectiveness of the demands, among
others, always in the sense of building a profile Of how these actions have been dealt
with in the gurupiense judiciary. In the end, the study allowed a critical analysis of the
profile of these actions, allowing the effective awareness of how this instrument of
jurisdiction has been treated in the region studied.
