Una de las manifestaciones del status privilegiado del que goza el crédito laboral es su
carácter persecutorio sobre los bienes del negocio (del empleador), el cual en su
aplicación judicial ha llevado a que se afecte la propiedad de un tercero que adquirió de
buena fe tales bienes, por la sola razón de que éstos en algún momento pertenecieron
al empleador deudor. La presente investigación ha buscado exponer con detalle la
problemática así generada y, en su parte final, sugerir la introducción de ciertos
correctivos en la legislación vigente que procuren una solución. / One of the signs of the privileged status granted to workers claims (credits) is the attribute
to persecute the employer assets. However, its implementation affects the rights of the
good faith acquirer of those assets, just because they previously belonged to the
employer. The purpose of this research has been to address the aforementioned
problem, and, at the end, to suggest some amendments to the current related legislation
in order to get a solution.
