La problemática del análisis de la motivación de los laudos arbitrales en los recursos
de anulación ha conllevado a innumerables debates al respecto. Estando a lo
mencionado, en el presente informe jurídico se procederá a analizar la procedencia
del recurso de anulación por motivación inexistente atendiendo a la causal recaída en
el literal b) del inciso 1 del artículo 63° de la Ley de Arbitraje, la cual fue invocada por
Provias Nacional en el recurso de anulación recaído en la Resolución N° 7 del
Expediente N° 00581-2019-0-1817-SP-CO-02. Para dicho efecto, se determinará el
estándar de la motivación en el arbitraje a partir de un examen exhaustivo de la
jurisprudencia nacional, la normativa aplicable y la doctrina calificada. / The problem of the analysis of the motivation of the arbitral awards in the annulment
appeals has led to innumerable debates in this regard. Given the above, in this legal
report we will proceed to analyze the admissibility of the appeal for annulment due to
non-existent reasons, taking into account the grounds relapsed in subparagraph b) of
subsection 1 of article 63 of the Arbitration Law, which was invoked by Provias
Nacional in the appeal for annulment filed in Resolution No. 7 of File No. 00581-2019-
0-1817-SP-CO-02. For this purpose, the standard of motivation in the arbitration will
be determined based on an exhaustive examination of the national jurisprudence, the
applicable regulations and the qualified doctrine.
